Entities of Bosnia and Hercegovina - back to the Dayton or on the road to integral state?

Abstract:

Bosnia and Herzegovina is nowadays considered to be more international protectorate than standard functional state. Two entities play an important role in this situation - Republic of Srpska and Federation of Bosnia and Herzegovina, which were constituted with exactly defined competencies on the basis of Dayton Peace Agreement. Despite overall tendency to preserve the provisions of Dayton peace treaty, recently we can witness the shift of many competencies from the level of entity to the state level – which is beyond the scope of the treaty. The continuation of this trend would mean the shift of Bosnia and Herzegovina to the direction of the central governed state, which is actually the objective of the international administration. On the other hand, especially in Republic of Srpska we can observe significant effort to reverse that development back to the status declared in the treaty. The aim of this diploma thesis is therefore to analyze in which direction the entities are about to develop and if there are any preconditions for Bosnia and Herzegovina to become a unitary state. The hypothesis is that the preconditions for Bosnia and Herzegovina to become a unitary state are present. The research itself is focused on mapping of the attitudes, desires and expectations of the main actors by direct field data collection in form of semi-structured interview. Data obtained by these interviews are analyzed and put into context through the analysis of secondary sources. The outcome of the research is comprehensive and clear picture of desired, ideal, and (which is the most important) probable role of entities in future state organization of Bosnia and Herzegovina.

Abstract:

Bosna a Hercegovina je dnes útvarom, ktorý je svojim charakterom považovaný skôr za medzinárodný protektorát, než za štandardne fungujúci štát. V tejto situácii zohrávajú významnú úlohu dve štátne entity Republika srbská a Federácia Bosny a Hercegoviny, ktoré boli konštituované na základe Daytonskej mierovej dohody s presne vymedzenými právomocami. Napriek všeobecnej tendencii k nemennosti ustanovení v nej obsiahnutých, v poslednom čase môžeme badať presun viacerých kompetencií z úrovne entít na celoštátnu úroveň, a to aj nad rámec Dohody. Pokračovanie tohto trendu by znamenalo posun Bosny a Hercegoviny smerom z centrálne riadenému štátu, čo je aj cieľom medzinárodnej správy. Na druhej strane je však možné najmä v Republike srbskej badať významné snahy o zvrátenie takéhoto vývoja späť ku stavu deklarovanom v Dohode. Cieľom diplomovej práce je preto zistiť, akým smerom sa bude uberať budúcnosť entít, a či existujú predpoklady k tomu, aby sa z Bosny a Hercegoviny stal unitárny štát. Hlavnou hypotézou je pritom téza, že v Bosne a Hercegovine takéto predpoklady existujú. Samotný výskum je zameraný na zmapovanie postojov, želaní a očakávaní hlavných aktérov pomocou priameho zberu dát v teréne a ich následnej kvalitatívnej analýzy. Výsledkom výskumu potom bude vytvorenie jasného a rozsiahleho obrazu nielen o želanej a ideálnej, ale najmä o pravdepodobnej úlohe entít v budúcom štátoprávnom usporiadaní Bosny a Hercegoviny.
