Abstract:

Diplomová práce se zabývá problematikou šikany na pracovišti. Cílem této závěrečné práce je zjistit míru informovanosti respondentů a jejich osobních zkušeností se šikanou na pracovišti skrze dotazníkové šetření doplněné o rozhovory s oběťmi šikany. Další cíl, jakožto vedlejší se zaměřuje na provedení hloubkové analýzy jednotlivých fází šikany na pracovišti. Cíle diplomové práce se podařilo naplnit. Z dotazníkového šetření vyplynulo, že respondenti mají nízké povědomí o šikaně na pracovišti a naopak spousta z nich se osobně s tímto jednáním na pracovišti setkala. Rozhovory s oběťmi šikany na pracovišti umožnily provést hloubkovou analýzu jednotlivých fází šikany. K dosažení stanovených cílů byly vybrány analytické, komparativní a dotazovací metody. Konkrétněji se jedná o analýzu a komparaci právních textů, dotazování formou dotazníkového šetření a rozhovoru. Vědecké metody doplňuje několik hypotéz a výzkumných otázek. Závěrečná práce je úzce provázána právními předpisy, obohacena o vybranou judikaturu včetně celé řady cizojazyčných publikací a rozbor zahraničních výzkumů. Praktická část reflektuje pouze první část výzkumu, přičemž ji můžeme považovat za velmi zásadní. Závěr diplomové práce je doplněn o podrobný popis druhé části výzkumu, tak aby ji mohl v budoucnu kdokoliv zrealizovat. Druhá část výzkumu se zaměřuje na provedení analýzy tzv. antimobbingového zákona v zahraničí včetně úvah de lege ferenda na přijetí zákonných opatření v souvislosti se šikanou na pracovišti v České republice. Závěr tedy obsahuje návrhy, jaká preventivní opatření by bylo možné přijmout za účelem snížení výskytu šikany na pracovištích v České republice.

Abstract:

This thesis deals with the issue of bullying at the workplace. The aim of this thesis is to find out the level of awareness of respondents and their personal experience with bullying at the workplace through a questionnaire survey supplemented with the interviews with the victims of bullying. The secondary goal focuses on execution of an in-depth analysis of individual phases of bullying at the workplace. The goals of the thesis were successfully fulfilled. From the questionnaire survey the fact, that respondents had low awareness of bullying at the workplace and, on the contrary, many of them personally encountered that behaviour at the workplace, emerged. Interviews with victims of bullying at the workplace made it possible to conduct an in-depth analysis of individual phases of bullying. Analytical, comparative and questioning methods were chosen to achieve the set goals. More specifically, they are an analysis and comparison of legal texts, questionnaire survey and interview. Several hypotheses and research questions complement the scientific methods. The final work is closely linked with legal regulations, enriched with selected judicature including several foreign-language publications and analysis of foreign. The practical part reflects only the first part of the research, and it can be considered very crucial. The conclusion of the thesis is complemented by a detailed description of the second part of the research, so that anyone can put it into practice in the future. The second part of the research focuses on the execution of the analysis of the so-called antimobbing law abroad, including de lege ferenda considerations on the adoption of legal measures in connection with bullying at the workplace in the Czech Republic. The conclusion therefore contains suggestions on what preventive measures could be taken to reduce the incidence of bullying at workplaces in the Czech Republic.
