Housing ownership, apartments owned by municipalities and social aspects of housing

Abstract:

Bakalářská práce je rozdělena na dvě části, přičemž jejich společným tématem je bydlení. V první části porovnávám definice vlastnictví, které se vyskytovaly v zákonech od roku 1989 až po aktuálně platný zákon č. 89/2012 Sb., občanský zákoník. Dále zde uvádím bližší informace o bytovém spoluvlastnictví a družstevním bydlení, jejich výhody i nevýhody a také zde zmiňuji čtyři právní tituly užívání bytu, tedy vlastnictví, nájem, podnájem a služebnost. Druhá část se zaměřuje na byty, které jsou ve vlastnictví obcí. Zmiňuji zde možnosti nabytí a vyvedení těchto bytů z majetku obcí, uvádím také, jaké druhy bytů ve svém majetku obce mají, čím se tyto byty od sebe liší a jak obce řeší problematiku bydlení pro sociálně slabé skupiny obyvatel, bez platného zákona o sociálním bydlení. Cílem bakalářské práce je zjistit, jestli zákonné změny, které probíhaly od roku 1989, měly pozitivní, nebo negativní vliv na vlastníky a nájemce bytů a zda obce tyto změny využily k prospěchu svých obyvatel. Odpovědět na tyto otázky mi pomohl také dotazník, ve kterém jsem se 20 českých a moravských měst ptala na jejich přístup k bytovému fondu po roce 1989 z pohledu počtu vlastněných bytů a případně jejich rozdělení z hlediska využití.

Abstract:

The bachelor thesis is divided into two parts, with housing as their common theme. In the first part of this thesis I compare the definitions of ownership according to the laws valid in the period from 1989 to the currently valid Civil Code. I provide more detailed information on housing ownership and cooperative housing, their advantages and disadvantages and I also mention four legal titles of apartment use, that´s ownership, rent, sublease and servitudes. The second part of the thesis focuses on apartments owned by municipalities. I mention here how the apartment can be acquired into the municipality's property, how it can be removed, I also state what types of apartments the municipalities have in their property, how these apartments differ from each other and how municipalities address the issue of housing for socially disadvantaged groups of the population, without the valid law on social housing. The aim of the bachelor thesis is to find out whether the legal changes that have taken place since 1989 have had a positive or negative effect on apartment owners and tenants and whether municipalities have used these changes to the benefit of their inhabitants. A questionnaire, in which I asked 20 Czech and Moravian cities about their approach to the housing stock after 1989 in terms of the number of owned apartments and their difference in terms of use, also helped me to answer these questions.
