Abstract:

Bakalářská práce se zabývá nutnou obranou, jako jednou z okolností vylučující protiprávnost v trestním právu České republiky. Cílem práce je zhodnotit aktuální právní úpravu nutné obrany v trestním právu, vyhledat a představit legislativní návrhy na změny této právní úpravy od roku 2014 do současnosti a tím nastínit možný budoucí vývoj tohoto institutu. V práci je uveden také stručný historický vývoj nutné obrany na území České republiky a dále srovnání s její právní úpravou ve Spolkové republice Německo a ve Slovenské republice. Autor vychází především z odborné literatury a judikatury vyšších soudů.

Abstract:

The bachelor thesis deals with necessary defense as one of the circumstances excluding illegality in the criminal law of the Czech Republic. The aim of the thesis is not only to evaluate the current legislation of necessary defense in criminal law but also to search for and present legislative proposals for changes to this legislation from 2014 to the present, and thus outline the potential development of this institute. The thesis provides a brief historical development of necessary defense in the Czech Republic and compares the Czech legal regulation with the legislation in the Federal Republic of Germany and the Slovak Republic. The author draws primarily on professional literature and case law of higher courts.
