Framework Legislation of the European Union

Abstract:

Cílem této diplomové práce je srovnat směrnice, jakožto právní akty I. pilíře, a rámcová rozhodnutí, jakožto právní akt pilíře III. Úvodní kapitola je věnována pramenům práva EU s ohledem na jejich rozdělení na prameny práva komunitárního a práva unijního v úzkém smyslu. Shody a rozdíly těchto dvou aktů se pokusím nejdříve vymezit na základě jejich definic. Další kapitola je věnována zásadám aplikace práva EU v národních právních řádech, tedy principu přednosti práva a principu přímého účinku. Následky nenáležité implementace potom tvoří obsah předposlední kapitoly. V závěru se pokusím nastínit problémy, které mohou vzniknout při implementaci rámcového rozhodnutí do národního právního řádu, a to na konkrétním příkladu Rámcového rozhodnutí o evropském zatýkacím rozkazu a postupech předávání mezi členskými státy.

Abstract:

The aim of my thesis is to compare two acts of the different pillars of the EU Law – directive and framework decision. This thesis commences with a brief look at the EU legal system in which two major branches are to be distinguished. Then I describe similitudes and differences between directive and framework decison on the basis of their definitions. The next part of the present work analyses principles of the application of the EU Law in the national legal orders, that is principle of the supremacy and the direct effect. The consequences of these two acts in the situation when they are not implemented or are implemented in a defective manner make a contents of the next chapter. In the end of my thesis I show the problems which can attend the process of implementation of the framework decision in the national legal order. Concretely the problems of the implementation of the Framework decision on the European arrest warrant and the surrender procedures between Member States.
