Consumer contracts and their use in practice

Abstract:

Tato bakalářská práce je věnována problematice spotřebitelských smluv a jejich využití v praxi. Cílem této práce je se seznámit spotřebitele, který má v oblasti spotřebitelských smluv pouze laické znalosti a zkušenosti, s českou právní úpravou spotřebitelských smluv. Práce je rozdělena do šesti kapitol. První kapitola stručně popisuje úlohu Evropské unie ve spotřebitelském právu. Druhá kapitola objasňuje základní pojmy spotřebitelského práva. Třetí kapitola se zabývá způsoby uzavírání spotřebitelských smluv, kterými jsou smlouvy uzavírané distančním způsobem, smlouvy uzavírané mimo obchodní prostory, smlouvy o finančních službách a timesharingové smlouvy. Čtvrtá kapitola se podrobněji věnuje kupní smlouvě a smlouvě o dílo, jakožto dvěma spotřebitelským smlouvám, se kterými se v praxi můžeme nejčastěji setkat. Pátá kapitola seznamuje čtenáře s nekalými obchodními praktikami a se zákazem nepřiměřených ujednání ve spotřebitelských smlouvách. Poslední šestá kapitola obsahuje praktickou část, která zahrnuje dotazníkové šetření, jehož se zúčastnilo 85 respondentů. Data byla následně zpracována a požadovaným výstupem byla interpretace jejich výsledků. Cílem výzkumu bylo zjistit, jaký mají respondenti přehled v oblasti spotřebitelských smluv.

Abstract:

This bachelor thesis is dedicated to the issue of consumer contracts and their application in practice. The aim of this work is to acquaint the consumer, who has only lay knowledge and experience in the field of consumer contracts, with the Czech legislation on consumer contracts. The work is divided into six main chapters. The first chapter briefly describes the role of the European Union in consumer law. The second chapter clarifies the basic concepts of consumer law. The third chapter deals with the methods of concluding consumer contracts, which are concluded contracts in a distance manner, contracts concluded off-premises, contracts for financial services and timeshare contracts. The fourth chapter deals in more detail with the purchase contract and the contract for work, as two consumer contracts, which we can meet in practice most often. The fifth chapter acquaints the reader with unfair commercial practices and the prohibition of disproportionate arrangements in consumer agreements. The last sixth chapter contains a practical part, which includes a questionnaire survey, which was attended by 85 respondents. The data were then processed and the required output was the interpretation of their results. The aim of the research was to find out what overview respondents have in the field of consumer contracts.
