Death in an employment relationship

Abstract:

Tato bakalářská práce je zaměřena na téma smrti v pracovněprávním vztahu. Cílem práce je poskytnout komplexní přehled této problematiky z pohledu subjektů v pracovněprávním vztahu a pozůstalých v kontextu českého právního prostředí. První část práce se věnuje vymezení pojmů související se smrtí v pracovním poměru. Druhá část představuje stručný náhled na vývoj pracovního práva. Třetí část vymezuje základní právní předpisy pracovního práva na mezinárodní, unijní a vnitrostátní úrovni. Čtvrtá část se věnuje subjektům pracovního poměru, tedy zaměstnanci a zaměstnavateli, a ukotvení těchto pojmů v právních předpisech. Pátá část představuje základní principy a zásady pracovního vztahu, včetně základních práv a povinností zaměstnance či zaměstnavatele. Šestá část se týká otázky smrti zaměstnavatele a důsledky této události na pracovní poměr. Závěrečná část se věnuje smrti zaměstnance, její důsledky a náhrady újmy a důchodů pro pozůstalé.

Abstract:

This bachelor thesis focuses on the topic of death in the employment relationship. The aim of the thesis is to provide a comprehensive overview of this issue from the perspective of the subjects in the employment relationship and the survivors in the context of the Czech legal environment. The first part of the thesis is devoted to the definition of terms related to death in employment relationship. The second part presents a brief insight into the development of labour law. The third part defines the basic legal provisions of labour law at the international, EU and national level. The fourth part deals with the subjects of the employment relationship, i.e. the employee and the employer, and the anchoring of these concepts in the legislation. The fifth part presents the basic principles and principles of the employment relationship, including the basic rights and obligations of the employee or employer. The sixth part covers the issue of the death of the employer and the implications of this event on the employment relationship. The final part deals with the death of an employee, its consequences and compensation and pensions for survivors.
