Security of the Slovak Republic in the sense of the Constitutional Act no. 227/2002 Coll., from 2020 to 2022

Abstract:

The main goal of the final thesis is, in terms of the legal order of the Slovak Republic, to subject the legal institute of the Constitutional Act no. 227/2002 Coll. on the security of the state in time of war, state of war, state of emergency and state of emergency, as amended during the 2020-2022 pandemic. The research task of two secondary objectives is to analyze and compare the adopted regulations on the basis of the ordered state of emergency, regarding the prohibition and restrictive measures of the state in terms of the constitutionally guaranteed rights: the right to freedom of movement and residence, the right to work, the right to peaceful assembly and the right to strike. as well as adopted regulations relating to restrictive measures against the inhabitants of Slovakia in terms of the constitutionally guaranteed right to protect public health. The conclusion of the thesis is the output of the findings of the retrospective analysis of the applied law on the security and defense of the state and the protection of the health of the population in the extraordinary conditions of the practice of the Slovak Republic.

Abstract:

Hlavným cieľom záverečnej práce je v zmysle právneho poriadku Slovenskej republiky, podrobiť skúmaniu právny inštitút ústavného zákona č. 227/2002 Z. z. o bezpečnosti štátu v čase vojny, vojnového stavu, výnimočného stavu a núdzového stavu v platnom znení v dobe pandémie rokov 2020-2022. Výskumnou úlohou dvoch vedľajších cieľov je na základe nariadeného núdzového stavu analyzovať a komparovať prijaté nariadenia, týkajúce sa zákazu a obmedzujúcich opatrení štátu v zmysle ústavne zaručených práv: právo slobody pohybu a pobytu, právo na prácu, právo na pokojné zhromažďovanie sa a právo na štrajk, ako aj prijaté nariadenia, vzťahujúce sa k obmedzujúcim opatreniam voči obyvateľom Slovenska v zmysle ústavne zaručeného práva na ochranu verejného zdravia. Záver práce je výstupom zistení retrospektívnej analýzy aplikovaného zákona o bezpečnosti a obrane štátu a ochrane zdravia obyvateľstva v mimoriadnych podmienkach praxe Slovenskej republiky.
