Trestněprávní úprava počítačové kriminality

Anotace: Počítačová kriminalita je relativně novým odvětvím trestné činnosti jehož vznik a vývoj je přímo spojen s rozvojem výpočetní techniky. Cílem této práce je upozornit na nebezpečnost počítačové kriminality, její rychlý rozvoj a problémy s tím související.

Abstract: In my thesis on computer criminality I have attempted to describe this relatively new branch of criminality. I dealt with differences from classic criminality, with an offender´s person, and I also presented some concepts how to solve the problematics. There are mentioned several cases from practice. The introduction explaines fundamental terms, describes system of dividing computer criminality according to various criteria, outlines its brief history and development concerning our country. Touches offender types and criminal investigation as well. The following part is devoted to the problematics of the attacks against computer and data. It involves the description of three different ways of a possible data access. The first, presented by a penetration from the outside, i.e. hacking. Here, I concentrated on particular program agents used for hacking. Another possibility is the penetration from inside. With the last one, combining two possibilities mentioned above, I payed closer attention to the methods of social engineering, phishing etc. Next section deals with criminal activities using computer. I mainly focused on disregard for copyright laws, which I divided into software piracy and audio-video piracy. The rest of this part describes in detail the most frequent patterns of copyright violation and also ways of illegal spread.Further I named the new facts of crimes, as they are presented in the new Criminal code, and their differences from the current legal regulations.In conclusion I summarized my thesis and suggested some solutions of before-mentioned problematics.
