Marriage and Registered Partnership within Point of View of the Register

Anotácia:

Předmětem této práce je srovnávací analýza právních předpisů upravujících matriku manželství od roku 1950, kdy matriční agenda přešla z církevní správy do správy státní a byla stanovena jednotná pravidla jejího vedení. Dále se bude práce zabývat právní úpravou matriky registrovaného partnerství. Tato právní úprava bude porovnána s právní úpravou matriky manželství, zejména z pohledu práv subjektů těchto dvou oblastí. Cílem práce je poukázat na nerovná postavení subjektů matriky manželství a matriky registrovaného partnerství, a také zjistit nedostatky v zákoně o matrikách, v části zákona o rodině, která upravuje uzavírání manželství a v zákoně o registrovaném partnerství. Na základě těchto zjištění budou předloženy vlastní návrhy de lege ferenda, které by tyto právní předpisy zefektivnily.

Abstract:

The object of this bachelor thesis is comparative analysis of legal regulations regarding registry of matrimony from the year 1950, when register offices were found and assumed the agenda of parishes (registering of deaths, births, weddings etc.) and when the rules of registering of these facts were unified. The bachelor thesis deals with the topics of registered partnership and its legislation. This legislation is going to be compared to matrimony legislation. The main objective is to point out the differences between rights of citizens in these two areas of law and to find out any imperfections of the family law, especially of the part about matrimony, and in the registered partnership law. On the basis of results of analysis this bachelor thesis will suggest some own propositions of de lege ferenda, which would increase the efficiency of the legal regulations.
