Mutual rights and obligations of an attorney and a client

Abstract:

Tématem této diplomové práce jsou vzájemná práva a povinnosti ve vztahu advokáta a klienta. Toto téma je velmi aktuální, a to zejména proto, že počet lidí, kteří se v dnešní době s žádostí o právní pomoc na advokáta obrací, je výrazně vyšší než v dobách dřívějších. Současně se neustále zvyšuje také počet aktivních advokátů na našem území. Cílem této práce je analýza vybraných vzájemných práv a povinností ve vztahu advokáta a klienta. V této diplomové práci je využito zejména poznatků z učebnic, dalších odborných monografií, právních předpisů a to včetně související soudní judikatury. Na začátku této práce jsou definovány základní pojmy advokacie, advokát a klient, které souvisejí s tématem. Rovněž je charakterizován vztah advokáta a klienta a popsány způsoby vzniku a zániku tohoto vztahu. Druhá kapitola se zabývá historickým vývojem právní úpravy advokacie na našem území, včetně možného vývoje do budoucna. Další kapitola se podrobněji věnuje jednotlivým právům a povinnostem ve vztahu advokáta a klienta, v této části jsou obsaženy také úvahy de lege ferenda. Závěrečná kapitola se zabývá důsledky porušení povinností, rozebírá druhy odpovědnosti advokáta a klienta a věnuje se rovněž kárnému řízení.

Abstract:

The topic of this thesis is mutual rights and obligations in the relationship between attorney and client. This topic is current these days, especially because the number of people who turn to a lawyer for legal aid nowadays is much higher than in the past. At the same time, the number of active attorneys in our territory is also steadily increasing. The aim of this thesis is to analyse selected mutual rights and obligations in the attorney-client relationship. This thesis mainly uses information from law textbooks, other professional monographs, legal regulations including related case law. At the beginning of this thesis the basic concepts of advocacy, advocate and client, which are related to the topic, are defined. This section also characterises the relationship between attorney and client and describes the ways in which this relationship is established and terminated. The second chapter deals with the historical development of the legal regulation of advocy in our territory, including possible future developments. The next chapter deals in detail with the individual rights and obligations in the attorney-client relationship, this section also contains de lege ferenda considerations. The final chapter deals with the consequences of a breach of duty, discusses the types of liability of the parties to the legal relationship and finally mentions the disciplinary procedure.
