Abstract:

Diplomová práce "Trest smrti v českém a mezinárodním právu" je zaměřena na charakteristiku trestu smrti z hlediska jeho funkce, kterou by měl jako trest plnit, na jeho postavení v rámci systému trestních sankcí, na alternativy k tomuto absolutnímu trestu a na nejužívanější druhy trestu smrti v dnešní době. Dále se práce zabývá historií a právní úpravou trestu smrti na území České republiky až po současnost a stávající legislativou upravující trest smrti na evropské i celosvětové úrovni. V závěru práce jsou shrnuty argumenty pro a proti ukládání trestu smrti a jejich zhodnocení. Cílem práce je celkové shrnutí problematiky týkající se trestu smrti a vyřešení otázky, zda by tento trest měl být užíván, či nikoli.

Abstract:

The Master´s thesis named "Death Penalty in Czech and International Law" is focused on characteristic´s of the death penalty from the viewpoint of its function, which death penalty should fulfill, on its position within the system of criminal penalties, on alternatives to this punishment and on the most widely used ways of executions in the present time. Hereafter this work deals with the history and the legislation of death penalty on the area of Czech Republic from the beginning to the contemporaneity and present legislation on European and global level. In the end are several summarized arguments containing the pros and cons of using death penalty and their appreciation. The purpose of this work is a general summary of the problems of using the death penalty and finding the answer to the question of if the death penalty should be used or not.
