A Consumer in a situation of Distance Selling

Abstract:

Tato diplomová práce je zaměřena na úpravu spotřebitelských smluv uzavřených mimo obchodní prostory obvyklé k podnikání, nebo nemá-li dodavatel stálé místo k podnikání. Práce se zabývá analýzou implementace směrnice Rady č. 85/577/EHS o ochraně spotřebitele v případě smluv uzavřených mimo obchodní prostory do občanského zákoníku, kdy jsou srovnávány jednotlivé články této směrnice se zněním občanského zákoníku, s poukázáním na judikaturu Evropského soudního dvora a judikaturu českou. V úvodu práce je rozebrán pojem spotřebitele a jeho práv, jak např. z pohledu českého práva, tak práva ES. Následuje historický vývoj spotřebitele v rámci Evropských společenství, poté byl proveden rozbor samotné směrnice a následně je popsána situace jejího projednávání v Parlamentu ČR, kdy novelou č. 367/2000 Sb. došlo k implementaci směrnice právě do občanského zákoníku. Pro srovnání s naším právním řádem byla zvolena Velká Británie, kde tato směrnice byla implementována do Nařízení o podomním prodeji z roku 1987 (Consumer Protection Regulations 1987 Cancellation of Contracts Concluded away from Business Premise). Práce je ukončena vymezením nástrojů ochrany spotřebitele v českém právním řádu, jak z pohledu soukromého práva, tak z pohledu veřejného práva.

Abstract:

This dissertation is focused on regulation of consumer contracts negotiated away from business premises usually used for business or when the trader has no permanent place of business. The dissertation deals with the analysis of implementation Council Regulation No. 85/577/EEC to protect the consumer in respect of contracts negotiated away from business premises in the Civil Code, comparing the individual articles of the Regulation with the wording of the Civil Code referring to the jurisdiction of the European Court of Justice and the Czech jurisdiction. The terms of consumer and the consumer’s rights are analysed at the beginning of the dissertation both, for example, from the viewpoint of the Czech law and the EC law, followed by the historical development of consumer rights within the European Communities. Then an analysis of the Regulation itself has been done, followed by the description of the Regulation consideration by the Czech Republic Parliament, after which the Regulation has been implemented in the Czech Civil Code by Amendment No. 367/2000 Coll. To make a comparison with our legal system was chosen Great Britain where this Regulation has been implemented in the Doorstep Contracts Act of 1987 (Consumer Protection Regulations 1987 Cancellation of Contracts Concluded away from Business Premise). The dissertation is concluded with defining the instruments of consumer protection in Czech legal rules, both from the viewpoint of private and public laws.
