The Czech Republic and the International Criminal Court from Point of View Parliamentary Political Parties of the Czech Republic

Abstract:

Tato bakalářská práce se zaměřuje na proces ratifikace Římského statutu Mezinárodního trestního soudu do českého právního řádu. V teoretické části pracuje se dvěma modely mezinárodního soudnictví, tedy s modelem mezinárodní a globální spravedlnosti. Na základě takto vymezených přístupů k mezinárodnímu soudnictví se snaží přiřadit i jednotlivé parlamentní politické strany k odpovídající teorii a charakterizovat tímto způsobem orientaci strany v otázce MTS. Hlavní částí práce je snaha potvrdit či vyvrátit hypotézu, že v technické a zahraničně-politické oblasti (v tomto případě oblasti týkající se problematiky Římského statutu), o které veřejnost nemá většího tušení, nerozumí jí a prakticky se jí nijak nedotýká, tvoří názor v rámci politických stran skupina odborníků, popřípadě odborník na danou problematiku, o jehož názory a tvrzení se poté opírá argumentace celé strany, a jejíž členové se od této argumentace příliš neodchylují, která je jádrem celé této práce. Struktura práce odráží výše zmíněná kritéria a pro dokreslení problematiky vztahu MTS a ČR je do rámce práce zahrnuta i aktivita českých nevládních organizací a EU ve věci ratifikace Statutu MTS Českou republikou.

Abstract:

This bachelor diploma work deals with the topic of ratification of the Rome Statute of the International Criminal Court to the Czech system of law. In the theoretical part it works with two models of international jurisdiction. On the basis defined approaches in such a way to the international jurisdiction it tries to classify particular parliamentary political parties to the corresponding theory and in this way characterize orientation of the party in the issue of the ICC. The core part of the work is to prove or disprove hypothesis, that in technical and foreign-political arena (in this case where it concerns the Rome Statute), which the public does not have much idea about, does not understand and whose lives are not commonly influenced by it; a group of experts creates an opinion in the frame of parliamentary political parties, eventually this opinion is created by an expert in a given area, whose opinion and statements are argued by the whole party, and party members do not divert from this position, which is the main aim of this work. The structure of the work reflects the afore-mentioned criterias and in order to sketching the issue of the relation between the ICC and the CR the activity of Czech non-governmental organizations is also included in this work and the EU regarding the ratification of the Statute of the ICC by the Czech Republic.
