Abstract:

Koncepcí této diplomové práce jsem se pokusila docílit uceleného přehledu institutu poškozeného v trestním řízení, v návaznosti na řadu novel týkajících se poškozeného, a to se zaměřením především na jeho postavení v trestním procesu, na obsah jeho práv, jeho postavení v odklonech, jakož i v řízení, kde má poškozený právo žádat náhradu škody, nemajetkové újmy v penězích anebo na vydání bezdůvodného obohacení, tedy tzv. adhezním řízení. Cílem této práce bylo vymezení pojmu poškozeného dle platné právní úpravy metodou kompilace, analýzy a syntézy doplněné judikaturními rozhodnutími soudů České republiky. K práci jsem zvolila juristický přístup, kdy jsem se zaměřila na rozbor právní úpravy s využitím dedukce, analýzy a komparace, kladla jsem si tak za cíl komplexním způsobem vysvětlit problematiku právního postavení poškozených, analyzovat jejich práva v českém trestním řízení, a to především vymezením procesních práv poškozeného jak v trestním řízení obecně, stejně tak v některých institutech spadajících do odklonů v trestním řízení, jako podmíněné zastavení trestního řízení, narovnání, trestní příkaz a řízení o schválení dohody o vině a trestu. Práce rovněž obsahuje komparaci české a slovenské právní úpravy, neboť právní úprava obou států byla řadu let upravena stejným kodexem z roku 1961, který je v České republice stále účinný, oproti Slovensku, kde již došlo k rekodifikaci trestního práva. Přestože na Slovensku mají od roku 2009 nový trestní zákoník i trestní řád a v mnohém je právní úprava obou zemí podobná, v komparační části práce jsem se tak zaměřila především na jejich odlišnosti týkající se poškozeného v trestním řízení. V České republice máme již od roku 2009 rekodifikovaný trestní zákoník, ovšem trestní řád z roku 1961, proto rekodifikace trestního řádu je de lege ferenda nutností, a to nejen s ohledem na právní úpravu týkající se poškozeného v trestním řízení, ale také dalších institutů trestního práva, jakož i soudní příslušnosti a dalších změn v souvislosti s plánovanou rekodifikací trestního řádu.

Abstract:

The concept of this thesis tries to achieve a comprehensive overview of the institute of the criminal proceedings in connection with a number of amendments concerning the injured party, focusing primarily on their position in the criminal procedure, on the content of their rights, their position in diversions, as well as in the proceedings where the injured party has the right to claim damages, non-pecuniary damage in cash or to issue unjust enrichment; the so-called adhesive procedure. The aim of my thesis was to define the term 'injured party' according to the valid legislation using the method of compilation, analysis and synthesis supplemented by the case law of the courts of the Czech Republic. I chose a juristic approach for my thesis and focused on the analysis of the legislation using deduction, analysis and comparison, aiming to explain in a comprehensive way the issue of the legal status of the injured party, to analyze their rights in Czech criminal proceedings, defining the procedural rights of the injured party both in criminal proceedings in general, as well as in some diversion institutes in criminal proceedings, such as conditional cessation of criminal proceedings, settlements, criminal orders and guilt and punishment approval procedures. The thesis also contains a comparison of the Czech and Slovak legislation, because the legislation of both states was regulated by the same code from 1961 for many years. This code is still in effect in the Czech Republic contrary to Slovakia where the criminal law has been recodified. In Slovakia the new Criminal Code and Criminal Procedure Code has been in effect since 2009. The legislation of Slovakia and The Czech Republic is similar in many ways and in the comparative part of the thesis I focused mainly on their differences concerning the injured party in criminal proceedings. In the Czech Republic, the Criminal Code has been recodified in 2009, but the Code of Criminal Procedure has been used since 1961, therefore recodification of the Code of Criminal Procedure is de lege ferenda a necessity, not only with regards to the legislation concerning the injured party in criminal proceedings, but also to other institutes of criminal law, as well as jurisdiction and other changes in connection with the planned recodification of the Code of Criminal Procedure.
