Freedom of Religion in Relation with Islam in the Czech Republic

Abstract:

This thesis analyzes the right to freedom of religion guaranteed by the Czech Constitution with regard to Islam and Muslims living in the Czech Republic. The first chapter introduces the general characteristics of this fundamental human right guaranteed by international treaties and national legislation. The author then analyzes Articles 15 and 16 of the Charter on Fundamental Rights and Basic Freedoms of Czech Republic. The second chapter describes the nature of Islam, and the current position of Muslim communities and believers in the Czech society. The chapter also describes the process of registration of religious groups under the Act. No 3/2002 Coll., on Religious Freedom and the Position of Churches and Religious Associations, as amended. The third and last chapter is devoted to an analysis of different forms of manifestations of religious belief. The author described in her thesis manifestations of religious belief’s forms that are stated in Article 6 of the Declaration on the Elimination of All Forms of Intolerance and of Discrimination Based on Religion or Belief.

Abstract:

Diplomová práca analyzuje ústavne zaručeného práva na slobodu vyznania v súvislosti s islamom, respektíve v súvislosti s vierou moslimov žijúcich na území Českej republiky. Z toho dôvodu sa v prvej časti práce zaoberám obecnou charakteristikou tohto základného ľudského práva a jeho garanciou záväznými právnymi dokumentmi na medzinárodnej, regionálnej a vnútroštátnej úrovni, kde sa obzvlášť venujem analýze kľúčových článkov 15 a 16 Listiny základných práv a slobôd. V druhej časti práce popisujem charakter islamu, islamských komunít a samotných veriacich v prostredí českej spoločnosti. V tejto časti venujem zvláštnu pozornosť registrácii náboženských skupín podľa zákona č. 3/2002 Sb., cirkevného zákona. V poslednej kapitole sa venujem jednotlivým prejavom náboženskej slobody, najmä tomu, do akej miery má tento životný štýl veriacich ovplyvnený pravidlami vyplývajúcimi z islamského náboženského práva a súčasne hranicami stanovenými recentnou právnou úpravou, možnosť sa realizovať, a pritom uplatňovať svoje právo na slobodu vyznania.
