Tripartite and Czech Republic Constitution and its Manifestation in Practice

Abstract:

Bakalářská práce "Tripartita v Ústavě ČR a její projevy v praxi" se zabývá dělbou moci, která je jedním ze základů každého demokratického státního zřízení. Na několika politických událostech jsou v práci také popsány konkrétní projevy dělby moci v ústavní praxi České republiky. Nejdříve je v práci vysvětlen pojem tripartita a s ním také princip brzd a vyvážení v parlamentním systému. Popsány jsou tři základní složky moci, které jsou na sobě nezávislé, ale zároveň se také kontrolují. Těmito složkami jsou moc zákonodárná, výkonná a soudní. V práci jsou představena také díla od několika autorů, kteří k historickému vývoji dělby moci výrazně přispěli. Dále je obsahem práce historický vývoj dělby moci na našem území, konkrétně od vzniku Československé republiky. První popisovaná ústava z roku 1920 je ústavou demokratickou a prvky dělby moci se v ní projevují velmi výrazně. Tato ústava se také stala vzorem při vzniku současné Ústavy České republiky. V práci jsou dále popsány ústavy z období totality, tedy z období let 1948 - 1989. Samostatně je pak analyzována současná právní úprava Ústavy, zejména z hlediska vzájemných vztahů moci zákonodárné, výkonné a soudní. Na tuto část navazuje popis konkrétních politických událostí, u kterých došlo k realizaci teorie dělby moci v České republice.

Abstract:

The bachelor thesis "Tripartite and Constitution of the Czech Republic and its Manifestation in Practise" deals with the division of power which is one of the foundations of every democratic state system. On several political events in this thesis are described concrete manifestations in constitutional practise of the Czech Republic. First, there is explanation of the concept of tripartite and principle of impediments and balances in parliamentary system. There are described three components of power which are independent on each other, but on the other hand they can control each other. These components are legislative, executive and judicial power. Further there are also introduced works by several authors, who distinctly contributed to historical development of division of power. Next part deals with historical development of division of power in our territory, specifically since the establishment of the Czechoslovak Republic. The first described constitution from the year 1920 is a democratic constitution and we can find there significant division of power. This constitution also becomes a model for the current constitution of the Czech Republic. Next there are described totalitarian constitutions, factually from years 1948 - 1989. There is separately analyzed current legislation of constitution, especially in terms of relationships of legislative, executive and judicial power. This part is followed by description of concrete political events, where was realized the division of power in the Czech Republic.
