Legal problems of buildings without permission

Abstract:

Diplomová práce je zaměřena na protiprávní jednání obsahující průběh správního řízení při nařízení odstranění staveb, které byly realizovány bez povolení či opatření stavebního úřadu. Byl kladen důraz na popis výkonu rozhodnutí o nařízení odstranění staveb postupem správního orgánu v exekučním řízení a soudním exekutorem. Byly uvedeny a specifikovány typy nepovolených staveb z hlediska stavebního zákona č. 183/2006 Sb., ve znění zákona č.350/2012 Sb., popsány příčiny a důvody vzniku staveb bez povolení. Práce seznamuje se základními postupy správního orgánu od zjištění protiprávního stavu, možnost napravení protiprávního stavu dodatečným povolením nebo naopak fyzickým odstraněním staveb. Popisuje postupy a možnosti fyzického odstranění staveb dobrovolně, dále náhradním výkonem rozhodnutí v podobě náhradního výkonu rozhodnutí správním orgánem, který rozhodnutí o nařízení odstranění stavby vydal v prvním stupni a důvody nízké účinnosti tohoto postupu a dále pomocí soudního exekutora a s tím spojené postupy a související problémy. Také se zabývá postihy za protiprávní jednání s rozdělením na přestupky u fyzických osob a na správní delikty u právnických osob a fyzických osob podnikajících. Kapitoly jsou propojeny s praktickými zkušenostmi ze stavebního úřadu. Na závěr jsou popsány návrhy nástrojů, které by měly sloužit ke snížení počtu realizovaných staveb bez povolení stavebního úřadu.

Abstract:

This thesis is focused on infringement containing the course of the administrative procedure in the regulation of the removal of the buildings, which have been carried out without authorisation or measures of the Building Authority. An emphasis was placed on description of enforcement of building removal by a procedure of the administrative authority in execution proceedings by a court bailiff. The work lists and specifies the types of illegal constructions in terms of the Building Act No. 183/2006 Coll., as amended by law no 350/2012 Coll., and describes the causes and reasons for emergence of buildings without permission. Furthermore, the work introduces basic procedures of administrative authority from the finding of the infringement, the possibility to remedy the infringement by an additional permit or, conversely, by a physical removal of the construction. It describes the procedures and options of physical removal of buildings on a voluntary basis, further based on substituted enforcement of judgment of administrative authority that issued a decision on order for the removal of a building in the first instance, and the reasons for the low efficiency of this procedure. It describes the procedures and options of physical removal of buildings by the means of a bailiff, the procedures associated with it, and related problems. It also deals with the penalties for infringements dividing them on natural person offenses and on administrative offenses committed by legal entities and by natural persons - entrepreneurs. The chapters are connected with the practical experience from the Building Authority. Finally, suggestions of tools that should be used in order to reduce the number of constructions realised without the permission of the Building Authority are given.
