Substantive Heart of the Constitution
Abstract:
Práce pojednává o materiálním ohnisku ústavnosti, které je zakotveno v čl. 9 odst. 2 a 3 Ústavy ČR jako absolutní zákaz změny tzv. podstatných náležitostí demokratického právního státu. Dále se obsah práce zaměřuje na pravomoc Ústavního soudu České republiky rušit ústavní zákony, která je spojena s kauzou poslance M. Melčáka. Závěr je věnován vybraným náležitostem demokratického právního státu.
Abstract:
This thesis aims to describe the substantive heart of the constitution, which is enshrined in Article 9, Subsection 2 and 3 of the Constitution of the Czech Republic, prohibiting any alteration of fundamental characteristics of a democratic legal state.
