Legal Moralism in the Case Law of Current Courts

Abstract:

Tato diplomová práce pojednává o právním moralismu a jeho aplikaci v judikatuře, kdy zkoumá projevy idejí tohoto právního směru při rozhodovací činnosti soudů a vliv názorů společnosti na konečné rozhodnutí. Zejména se tato práce soustředí na pojem morálky, její rozlišení a její ochranu. Dále jsou pak v práci zkoumány situace, kdy se právní normy s morálními normami buďto rozchází, shodují anebo na sebe nemají vliv. V neposlední řadě se tato práce taktéž soustředí na význam společnosti v právním moralismu, přičemž čerpá ze starší teoretické literatury, ale i z novodobé právní praxe.

Abstract:

This diploma thesis deals with legal moralism and its application in case law where it examines the manifestations of the ideas of this legal doctrine in the practice of the courts and the influence of society’s views on rulings. In particular, the thesis focuses on the concept of morality, its distinction and its protection. Furthermore, the thesis exam-ines situations where legal norms with moral norms either diverge, coincide or do not affect each other. Last but not least, the thesis also focuses on the importance of society in legal moralism.
