Abstract:

Práce se zabývá problematikou sociální práce s pachateli trestných činů. V textu se snaží hledat odpověď na poznávací otázku: Jaká jsou pojetí pachatele z hlediska sociální práce jako profesní činnosti? K zodpovězení volí fenomenologickou perspektivu poznání reality a využívá způsob uchopení a slovní výbavu definovanou Alfredem Schützem. V první řadě na základě jím definovaných pojmů vytváří základní strukturu uchopení sledovaného pojetí, u kterého tak rozlišuje: objekt pojetí, subjekt pojetí a způsob porozumění pojetí pachatele. Na základě této struktury jsou pak definovány základní prvky hlediska sociální práce. U těch je pak ještě rozlišováno mezi vymezením sociální práce jako teorie a jako praxe. Jsou představena konkrétní kolektivní pojetí pachatele z hlediska sociální práce definované v praxi. Jedná se o obecné pojetí pachatele jako uživatele sociálních služeb, a pak specifická pojetí pachatele. Mezi ty patří pojetí pachatele jako osoby ve výkonu trestu odnětí svobody, pojetí pachatele Probační a mediační služby, pojetí pachatele sociálních kurátorů a pojetí pachatele nestátních neziskových organizací. Metodologická část představuje základní fenomenologická východiska, a to jak ve vztahu k sledovanému fenoménu, tak k realizaci výzkumu. Vzhledem k charakteru zkoumaných dat je volena kvalitativní strategie, konkrétně fenomenologické rozhovory doplněné terénními poznámkami a metodou nedokončených vět. Bylo provedeno 23 rozhovorů s 12 respondenty. Zjištěná data jsou prezentována ve dvou kapitolách. První kapitola se snaží představit převážně primární interpretace, a to pouze za pomoci základní struktury pojetí definované v teorii – subjekt pojetí, objekt pojetí, způsob porozumění. Druhá kapitola již představuje více sekundární interpretace druhého řádu. Pojetí pachatele obsahují jak kolektivní, tak individuální interpretace, a to nejen samotného objektu pojetí, ale také subjektu pojetí. Pojetí pachatele podle výpovědi vybraných subjektů pracujících na pozici sociálního pracovníka se vyznačuje těmito fenomény: Význam pomoci a potřeb ve vztahu pachatele – společnost; bezmoc a moc ve vztahu k systému; důrazem na individualitu a typifikacemi podle systému nebo podle motivace pachatelů; empatií a snahou o pochopení pachatele a jeho situace; otázkou úspěchu a neúspěchu pachatele; významem komunikace při práci s pachateli; otázkou manipulace, účelového jednání a nedůvěry; balancováním mezi empatií a důvěrou a obezřetností a mezi relevancemi organizace a sociální práce jako profese.

Abstract:

This work focuses on the topic of social work with crime offenders. We try to address the research question: What are the views on the crime offenders from the point of view of social work as a professional activity? We have chosen the phenomenological view for getting insight of the reality with the help of word dictionary defined by Alfred Schütz. First we have defined the basic structure for capturing the phenomenon at hand (view on crime offenders) with following defined terms: object of the view, subject of the view, and the way of understanding. This structure is used to define basic concepts of social work view from the theoretical as well as practical view. We discuss concrete collective views on crime offenders: crime offender as user of social services, crime offender as a imprisoned person, crime offender from the view of Probation and Mediation Service of the Czech republic, crime offender from the view of social curators and NGO. Methodological part introduce basic phenomenological roots in connection to the phenomenon in focus and realization of our research. Qualitative strategy – repeated phenomenological interviews with 12 respondents – is used which is further supported by field notes and the technique of unfinished sentences. The research results are presented in two parts. First part presents primary interpretations of the respondents based on basic structure of the view: subject of the view, object of the view, and the way of understanding. The second part presents secondary interpretations by the author. The views on the crime offenders include collective and individual interpretations of the object and the subject of the view. According to statement of selected social workers the following phenomenon were identified: importance of help and needs in the relationship between the crime offender and the society, power and powerlessness in relationship to the system, importance of focus on individual, typifications based on system or motivation of crime offenders, empathy and understanding of crime offender in his/her situation, the question of success and fail in the work with crime offenders, importance of communication in the social work with crime offenders, manipulation and trust, balancing between empathy and cautiousness, balancing between relevance of organization and relevance of social work as a profession.
