Abstract:

Práce se zabývá zkoumáním struktury financování základních jednotek české římskokatolické v ekonomických a právních podmínkách demokratické společnosti po roce 1989. Cílem práce je analyzovat strukturu financování diecézí římskokatolické církve v České republice po roce 1990 v závislosti na změnách instucionálně-legislativního rámce. Práce odpovídá na otázky týkající se vztahu církví a státu v ekonomické rovině a v oblasti financování, konkretizované na největších subjektech římskokatolické církve v České republice. Práce je založena na empirickém výzkumu, tedy sběru a analýze dat. Tato data následně vyhodnocuje a zasazuje je do legislativně institucionálního kontextu ve smyslu přístupu "Law & Economics". Další metodou bude komparace, kdy budou srovávána data z veřejných rozpočtů a z vnitrocírkevních zdrojů, která umožní zjistit podíl hospodaření s vlastním majetkem a vlastní získávání zdrojů na celkovém objemu hospodaření. Konečně bude použita metoda ekonomické analýzy práva v konkrétních ekonomických jednotkách s cílem odhalit příčinné vztahy mezi hospodařením těchto jednotek a účinností konkrétních právních norem, které toto hospodaření upravují. Přidaná hodnota práce bude spočívat ve zjištění vlivu příslušných právních norem na ekonomiku dotčených subjektů a stanovení předpokladu vývoje hospodaření těchto subjektů v závislosti na platném legislativně-institucionálním rámci.

Abstract:

The thesis deals with the structure of the financing of the Czech Roman Catholic basic units in the economic and legal conditions of the democratic society after 1989. The aim of the thesis is to analyze the structure of the Roman Catholic Church dioceses in the Czech Republic after 1990, depending on changes in the institutional-legislative framework. The work is based on empirical research, i.e. data collection and analysis. These data will be evaluated and put in a legislative institutional context in the sense of the "Law & Economics" approach. Another method will be a comparison, when the data from public budgets and from internal church resources will be compared, which will enable to find out the part of own property in the economy and own resourcing in the economy as a whole. Finally, the method of economic analysis of law will be used in specific economic subjects in order to reveal the causal relations between these subjects economy and the effectiveness of the specific legal norms that regulate this economy. The added value of the thesis will consist of finding the effect of the relevant legal standards on the economy of the concerned units and the assumption of the economic development of the subjects according to the valid legislative-institutional framework.
