Supervision of the Probation Officer and his Performance

Abstract:

Cílem této diplomové práce je představit činnost Probační a mediační služby, zejména však jednu z možností alternativního trestání, probační dohled. První kapitola je věnována představení Probační a mediační služby a probačního dohledu, její působnosti a historickému vývoji. V druhé části je rozebírán dohled z pohledu mladistvých. Třetí kapitola představuje samotný probační dohled u dospělých pachatelů, jak fungu-je a za co se ukládá. Čtvrtá kapitola pojednává o působnosti probačního dohledu na pachatele a vliv na jejich další chování a zamezení recidivy. V předposlední části je rozebírána nejpodstatnější novela poslední do-by ohledně zrušení probačního dohledu a v poslední kapitole je porov-náván dohled s ostatními zeměmi ve světě, obzvláště s našimi sousedy, nebo se zeměmi, kde samotná probace vznikla, s ohledem na její vývin na jednotlivých územích. V závěru práce autor hodnotí jednotlivé po-znatky, poukazuje na problémy a uvádí možnosti řešení de lege ferenda.

Abstract:

The aim of this diploma thesis is to present the activities of the Proba-tion and Mediation Service, especially one of the options for alternative punishment, probation supervision. The first chapter is dedicated to the introduction of the Probation and Mediation Service and probation supervision, its scope and historical development. The second part dis-cusses supervision from the perspective of juveniles. The third chapter presents probation supervision itself for adult offenders, how it works and what it is imposed for. The fourth chapter discusses the scope of probation supervision over offenders and the effect on their further behaviour and prevention of recidivism. In the penultimate part, the most significant recent amendment regarding the abolition of proba-tion supervision is discussed, and in the last chapter, supervision is compared with other countries in the world, especially with our neigh-bours, or with countries where probation itself originated, with regard to its development on individual territories. At the end of the work, the author evaluates individual characteristics, points out problems and presents possible solutions de lege ferenda.
