Resolving conflicts within a sports organisation with a focus on conflicts in a football enviroment

Abstract:

Práce pojednává o alternativním řešení sporů se zaměřením na fotbalové prostředí. Úvod je historickým exkurzem do vztahu sportu a práva, který přechází do současného pojetí sportu. V kapitole je rovněž obsažena jeho právní úprava s důrazem na zákon o podpoře sportu, jakožto jediného speciálního sportovně právního předpisu u nás. Další část práce nese název ,,Řešení sporů ve fotbalovém prostředí", která počíná výkladem o sportovní organizaci a o její právní formě, kterou je zpravidla spolek. V nejedné z podkapitol je rozebrána organizační struktura ve fotbale, s důrazem na FAČR, jenž je národní úrovní organizace. Podrobně je zde popsán průběh řešení sporů před jeho vnitřními orgány. Na tuto část práce navazuje další kapitola pojednávající o možnosti domáhat se svého práva u Mezinárodního arbitrážního soudu v Lausanne. Rovněž je zde analýza konkrétního případu, kdy dojde k aplikaci psané teorie do praxe. Samotný závěr práce pak pojednává o moci soudní a o tom, kdy je na místě obrátit se na nezávislý a nestranný soud v souvislosti se vzniklým sporem v rámci sportovní organizace. Obsahem kapitoly je zároveň analýza kladů a záporů řešení sporů interně v rámci sportovních spolků namísto řešení sporů podáním žaloby k obecnému soudu a domáháním se spravedlnosti u moci soudní.

Abstract:

The thesis deals with alternative dispute resolution with a focus on the football environment. The introduction is a historical excursion into the relationship between sport and law, which transitions into its contemporary conception. The chapter also covers its legal regulation, with an emphasis on the Law on the Promotion of Sport, as the only special sports law in the country. The next part of the thesis is entitled "Dispute resolution in the football environment", which starts with an explanation of the sports organisation and its legal form, which is usually a society. In one of the subchapters the organisational structure in football is discussed, with emphasis on the FAČR, which is the national level of the football structure. The process of dispute resolution before its internal bodies is described in detail. This part of the thesis is followed by another chapter dealing with the possibility of seeking redress before the International Court of Arbitration in Lausanne. There is also an analysis of a specific case where the written theory is applied in practice. The very end of the thesis then discusses the power of the judiciary and when recourse to an independent and impartial tribunal is appropriate in relation to a dispute arising within a sports organisation. The content of the chapter also analyses the pros and cons of resolving disputes internally within sports associations instead of resolving disputes by bringing a claim to a general court and seeking justice from the judiciary.
