Circumstances of Justification - Self Defence

Abstract:

Anotace Téma, které jsem zvolil je velmi rozsáhle a prostor pro jeho rozebrání je v této práci omezený. Co se týče okolností vylučujících protiprávnost rozhodl jsem se probrat pojem trestní odpovědnosti jako celku a v další části mojí práce se probrat velmi ošemetnou podstatou okolností jež vylučují protiprávnost a alespoň z části tak osvětlit situace a druhy ,které spadají do dané problematiky. Stěžejním bodem, kterým je nutná obrana, se budu zabývat nejrozsáhleji, protože si myslím, že se od ostatních okolností odlišuje a je třeba na tento rozdíl zejména mezi nutnou obranou a krajní nouzi poukázat. Závěrem se chci věnovat užití okolností vylučujících protiprávnost v běžném životě.

Abstract:

Annotation The topic I have chosen is very large and the space to discuss it in detail in the Thesis is limited. Concerning the circumstances excluding lawlessness I have decided to discuss the concept of criminal responsibility as a whole, and in another part of the Thesis, to discuss the very tricky essence of the circumstances which exclude lawlessness, and therefore at least in part to explain the situations and types that fall into this category. The main point, that is necessary self-defense, will be treated extensively because as it differs from the other circumstances and it is necessary to point out this particular difference between necessary self-defense and extréme distress. Finally, I want to discuss the use of circumstances excluding lawlessness in everyday life.
