Public contract replacing zoning and building permit for the construction of "laboratory VŠTE"

Abstract:

Tato bakalářská práce se zabývá vypracováním veřejnoprávní smlouvy nahrazující územní rozhodnutí a stavební povolení na stavbu laboratoří areálu VŠTE. Jsou v ní vyjmenovány náležitosti potřebné k návrhu veřejnoprávní smlouvy, a dále je popsán samotný proces od návrhu veřejnoprávní smlouvy, jejího uzavření až po její účinnost. V práci dojde k porovnání postupu při uzavírání veřejnoprávní smlouvy nahrazující územní rozhodnutí a stavební povolení s postupem pro vydání územního rozhodnutí a stavebního povolení, kterému předchází klasické správní územní a stavební řízení. Samostatnou částí je vyhodnocení efektivnosti veřejnoprávní smlouvy jak z hlediska stavebníka, tak z hlediska stavebního úřadu.

Abstract:

This bachelor work deals with the subject of public law contract, specifically that kind which substitutes spatial planning permission and building permission for construction of laboratories in the location of VŠTE. Necessary requisites of the contract’s draft are described, then follows the legal procedure finishing in the efficiency of the legal act. The paper contains also the comparative part that shows the differences between standard procedure and public law contract one. The independent part of the paper is concerned with the effectiveness of the public law contract from the point of view of builder and from the point of view of the building office.
