Material Publicity of Public Registers

Abstract:

Tato diplomová práce se zabývá veřejným seznamem jako právním pojmem a jeho definičními znaky. Dále se diplomová práce zaměří na předmět evidence veřejných seznamů, tedy na věci v právním smyslu slova. Následně rozebírá princip materiální publicity jakožto projev institutu nabytí práva od neoprávněného, přičemž budou rozebrány i související právní instituty, kterými jsou zejména poznámka rozepře a poznámka spornosti. Zjištěné poznatky budou promítnuty do analýzy speciální právní úpravy dalších veřejných seznamů, kterými jsou katastr nemovitostí a námořní rejstřík.

Abstract:

This diploma thesis firstly introduces the concept of public registers, providing their definition and characteristics. Subsequently, the thesis explains the object of the public registers – things in the legal sense. Then, the thesis delves into material publicity as a form of acquisition by an unauthorized person and related legal institutes, such as the note of dispute in both of its forms. The findings will be reflected in the analysis of the special regulations of other public registers, namely the cadastral register and the maritime register.
