Abstract:

Rozhodčí řízení obecně má velmi široký prostor působnosti, i když přihlédneme k tomu, že vývoj v některých jeho aspektech směřuje k větší míře regulace. Nejinak tomu je u osoby rozhodce, má obecně široký prostor působení, ale i jeho postavení je v poslední době více regulováno, např. v oblasti spotřebitelských sporů. Rozhodce má specifickou roli, která je na jedné straně vyjádřením vůle stran delegovat své právo rozhodnout o svých sporech a na druhé straně příkladem toho, že monopol státní moci nemusí být absolutní. Stát jde tedy v tomto případě, pokud se podíváme na problematiku z širší perspektivy, opačným směrem, než v řadě dalších oblastí a umožňuje lidem získat větší možnost disponovat se svými právy, za cenu větší odpovědnosti. Odpovědnosti, která počíná vybráním vhodného rozhodce pro konkrétní řízení; vhodných pravidel i rozhodčí instituce. Odpovědnost, která vzniká absencí veřejné moci v procesu rozhodování a vydání nálezu. Až v momentě vykonání rozhodčího nálezu dochází k průniku rozhodčího řízení s exekučním, když je zde platně vydanému nálezu rozhodců přiznáno uznání a vykonatelnost jak na tuzemské, tak na mezinárodní úrovni. Odpovědnost však neplyne jen stranám řešící své spory v rozhodčím řízení, ale též rozhodcům, kteří v rámci své role mají povinnost rozhodnout objektivně (nepodjatě) a respektovat principy rozhodčího řízení. Ze srovnání českých a zahraničních rozhodčích institucí vyplývají značné podobnosti rozhodčího řízení i postavení arbitra. Toto je dané tím, že mnoho institucí vychází z UNCITRAL Arbitration rules. Rozdíly jsou obecně hlavně v postavení rozhodčích institucí, konkrétně v tom, zda-li mají větší vliv na rozhodčí řízení či zda více záleží na vůli stran. Záměry vytyčené v úvodu této práce, tedy analýza postavení rozhodce a rozhodčích institucí a částečná komparace se zahraniční situací, byly zpracovány v průběhu celé práce i s úvahami autora práce na daná témata. Role rozhodce byla vymezena v rámci ADR i rozhodčího řízení, po praktické i teoretické stránce, v rámci ad hoc i institucionálního rozhodčího řízení.

Abstract:

The person of arbitrator in arbitration The arbitration has a very wide scope of use, even though it has been particularly more regulated in recent years. The regulations have impact on a position of arbitrator mostly in area of consumer law. This thesis deals with a position of arbitrator equally, theoretically and practically, when it focuses on regulation of a sole arbitrator and the rules of arbitral institutions. Out of all arbitral institutions are choosen Rozhodčí soud při Hospodářké komoře České republuky a Agrární komoře České republiky (Arbitration Court attached to the Economic Chamber of the Czech Republic and Agriculture Chamber of the Czech republic) for its dominant position in Czech arbitration. Amongst the foreign arbitral institutions are choosen International Court of Arbitration of International Chamber of Commerce and London Court of International Arbitration, to draw a comparison. The arbitrator has a specific role, because his right to decide the disputes comes both from a contract between sides of the disputes and from the state which is a guarantor of legal scope of arbitration. The state through the arbitration returns people in commercial area right to handle their own disputes without a state intervention. With that comes a bigger responsibility for their actions, as choosing an arbitrator or arbitral institution, than responsibility in civil proceeding guaranteed by state. In arbitration is state active, only after the main phase in recognition and enforcement of arbitral awards. The position of arbitrator is defined in the provisions of international law, state laws and in the arbitral rules of particular arbitral institutions. A significant part of arbitration is being influenced by the UNCITRAL organization, when its Model law influence many state laws and its Arbitral rules influence many rules of the arbitral institutions. All this being analyzed in the thesis, compared and appropriate conclusions about similarities and differences have been drawn. Responsibility is also connected with an arbitrator, since he is responsible for some aspects of arbitration as leading the proceeding and making the final decision. The future of arbitration in Czech Republic might change in many ways. Nowadays, we can see its evolving in the consumer law, following a trend set up by the European Union. Other changes might occur in the right of the legal entities to decide disputes in arbitration which is not legal at this moment. A part of it can be changed by the Czech state courts, but anything else must be changed by the Czech lawmakers. Less possible eventualities are changes coming from a level of international law, because it is harder to find a compromise in there. The final prediction in this thesis is an expansion of arbitration amongst the bigger number of Czech public. It is correlative of increasing knowledge of law and "faster" lifestyle of many people. When we compare the state courts with their time to reach final decision, from the start of proceeding to the end in average time can be counted in years, and arbitration which usually takes a few months, the arbitration is definitely more suitable.
