Question as a Cross-Examination Strategy to Discredit a Witness: A Linguistic Analysis of the Defamation Case Johnny Depp V. Amber Heard

Abstract:

Tato práce podrobně popisuje zkoumání strategií křížového výslechu, které používají právníci v americkém soudním systému k diskreditaci svědecké výpovědi před poro-tou. Hlavním zaměřením teoretické části práce je charakteristika procesu výslechu, konkrétně jazykové strategie používané advokátem při křížovém výslechu k diskre-ditaci svědecké výpovědi. Empirická část práce je pak založena na 180 stranách pře-pisu křížového výslechu Amber Heard z případu Depp vs. Heard z roku 2022. Hlavní zjištění jsou představena prostřednictvím 36 příkladů sekvencí otázka-odpověď, kte-ré demonstrují použití specifických strategií křížového výslechu a jejich individuální diskreditační vlastnosti. Zjištění naznačují, že některé strategie jsou více diskreditují-cí než jiné.

Abstract:

This thesis details the investigation of cross-examination strategies used by lawyers in American adversarial judicial system to discredit the witness’s testimony in front of the jury. The main focus of the theoretical part of the thesis are the characteristics of the examination process, specifically the linguistic strategies utilised by the lawyer in cross-examination to discredit the witness’s testimony. The empirical part of the thesis is then based on 180 pages of transcript of Amber Heard’s cross-examination from the 2022 case Depp v. Heard. The main findings are introduced via 36 exam-ples of question-answer sequences which demonstrate the employment of the spe-cific cross-examination strategies and their individual discrediting properties. The findings indicate that certain strategies are more discrediting than others.
