Principle of subsidiarity of criminal repression in recent theory and practice of the Czech criminal law

Abstract:

Autorka se v předkládané rigorózní práci zabývá zásadou subsidiarity trestní represe coby nezbytným východiskem pro zákonodárce i aplikační praxi, jejíž vymezení v legislativní podobě § 12 odst. 2 trestního zákoníku se však ani jedenáct let od jeho účinnosti v české trestněprávní teorii a praxi neustálilo. Cílem této práce je analýza nahlížení současné české odborné literatury na zásadu subsidiarity trestní represe, a to také v kontextu jejích historických i komparativních souvislostí, jakož i kritický rozbor relevantní rozhodovací praxe (zejména) Nejvyššího a Ústavního soudu. V neposlední řadě práce nabízí vlastní pohled autorky na předmětnou základní zásadu trestního práva hmotného, a to z hlediska jak jejího teoretického uchopení, tak především faktického uplatnění.

Abstract:

In submitted doctoral thesis, the author deals with the principle of subsidiarity of criminal repression as an inevitable basis for legislator and the application practice. However, definition of this principle in its legislative form of the Section 12 par. 2 of the Czech Criminal Code has still not consolidated in the Czech criminal law theory and practice even eleven years since its efficiency. The aim of this work is to analyze assumption of this principle by the recent Czech specialized literature in relation to its historical and comparative context as well as to critically analyze relevant decision making practice of (mainly) the Czech Supreme Court and Constitutional Court. Finally, the work provides author´s own perception of this basic principle of the substantive criminal law from both its theoretical comprehension and factual use.
