Exemptions from Protection of Endangered Species of Wild Fauna and Flora

Abstract:

Tato diplomová práce pojednává o výjimkách z ochrany ohrožených druhů volně žijících živočichů a planě rostoucích rostlin, a to z pohledu práva. V úvodních kapitolách autorka předkládá obecná východiska ohrožených druhů, která zahrnují především prameny mezinárodní, unijní a české vnitrostátní právní úpravy. Jádrem celé práce je charakteristika a rozbor těch nejvýznamnějších výjimek z ochrany ohrožených druhů. Pozornost je nejprve věnována výjimkám upraveným v zákoně č. 114/1992 Sb., o ochraně přírody a krajiny, ve znění pozdějších předpisů, a následně výjimkám plynoucím z regulace obchodování s exempláři ohrožených druhů. Cílem práce je zjistit, jakým způsobem jsou předmětné výjimky regulovány, poukázat na možné nedostatky právní úpravy a poskytnout o těchto výjimkách dosud chybějící ucelený přehled.

Abstract:

This diploma thesis deals with exemptions from protection of endangered species of wild fauna and flora from the perspective of law. In the opening chapters, the author presents the general background of the endangered species, which primarily include sources of international, EU and Czech law. The main point of the thesis is a description and analysis of the most significant exemptions from protection of endangered species. Firstly, the attention is paid to the exemptions laid down under the Act No. 114/1992 Coll., on nature and landscape conservation, as amended, and subsequently to the exceptions resulting from the regulation of trade in endangered species. The aim is to determine how exemptions in question are regulated, to point out possible shortcomings of the legislation and provide for these exemptions until now missing a complex overview.
