The First Instance and Second Instance Administrative Authority Relations Within an Appeal Procedure

Abstract:

Diplomová práce se zaměřuje na vztah správního orgánu prvního a druhého stupně v odvolacím řízení a klade si za cíl posoudit současnou právní úpravu této fáze řízení z pohledu požadavků na něj kladených, a to primárně obecnými zásadami a dále zásadami správního řízení. Důraz je kladen na efektivitu řízení s přihlédnutím k zachování standardu ochrany práv účastníků řízení. Po úvodním představení základních pojmů dochází ke kritické analýze současného stavu a vymezení vztahů orgánů v odvolacím řízení spolu s komparací odvolání v rakouské úpravě a daňovém řádu. Celá práce je završena syntézou poznatků a návrhem jednotlivých dílčích změn de lege ferenda.

Abstract:

The thesis is focuses on relation between the first and the second level administrative body in the appeal proceedings and it´s aim is to assess the current legal regulation of this stage of the procedure in terms of the requirements imposed on it, primarily by the general principles and the principles of administrative proceedings. Emphasis is placed on the efficiency of the procedure, taking into account the preservation of the standard of protection of the rights of the parties. Following the initial definition of the concepts, there is a critical analysis of the current situation and the delineation of the authorities' relations in the appeal proceedings together with the comparison of the appeals in the Austrian regulation and the Tax Code. The whole work is completed by the synthesis of the findings and the proposal of the partial changes de lege ferenda.
