Form of Criminal Participation - Accesority of Participation

Abstract:

Předkládaná diplomová práce je věnována problematice účastenství a to především z pohledu akcesority účastenství, tedy závislosti trestní odpovědnosti účastenství na trestní odpovědnosti hlavního pachatele. Předmětem zkoumání je zejména výklad forem trestné součinnosti de lege lata, tj. platná právní úprava obsažená v zákoně č. 40/2009 Sb., trestní zákoník. Obsažený text je průběžně doplňován i návrhy de lege ferenda. Trestná součinnost je složitým stále diskutovaným tématem teorie trestního práva. Složitost problematiky účastenství je spatřována především ve skutečnosti, že pomocí tohoto institutu je možné postihnout jednání, které zpravidla bezprostředně nenaplňuje znaky skutkové podstaty trestného činu. Zároveň jsou v diplomové práci porovnány jednotlivé formy trestné součinnosti se zdůrazněním jejich vzájemných souvislostí, jako je podobnost nebo naopak odlišnost a konečný vliv těchto skutečností na posouzení trestnosti a stanovení trestu.

Abstract:

The submitted thesis is concerned with problematic participation. That is main view accesority of participation. That dependes on criminal resposibility of participation on a crime of the main offender. Subject of search is interpretation criminal participation forms de lege lata, that means – Valid legislation in Act. No. 40/2009 Coll., Criminal Code. Contained text is continuously supplemented with proposals de lege ferenda. The issue of criminal liability for participation in the offense is one of the most complicated issues of criminal law theory and practice. The complexity of problem stems primarily from the fact, that the institute of complicity prohibits a conduct, which is not ordinarily directly fulfilling the basic elements of the crime offense. In this dissertation are compared all forms of criminal participation with making attention on mutual connection. Like is similarity, or dissimilarity and final influence on these facts and prescribing detailed sentences.
