Identification of Differences in the Permitting Process – Accommodation Facility vs. Apartment Building

Abstract:

Diplomová práce se věnuje povolovacímu procesu u staveb ubytovacího zařízení a bytového domu, a vysvětlení fungování povolovacího procesu v České republice. Cílem je identifikovat rozdíly v povolovacím procesu z hlediska stavebního zákona při posuzování dvou druhů staveb - ubytovacího zařízení a bytového domu. Práce je rozdělena na tři základní části: teoretickou, analytickou a návrhovou. Části jsou nadále rozděleny do kapitol a subkapitol. Teoretická část je věnována základnímu vymezení hotelnictví a stavebnictví. Analytická část detailněji vysvětluje povolovací proces ubytovacího zařízení a bytového domu. Poukazuje na zákonné požadavky těchto druhů staveb a celkový vývoj stavebnictví. V návrhové části jsou popsány největší nedostatky v systému povolovacího procesu, a doporučení na jejich eliminaci. Také je zmíněn nový stavební zákon, který by se na dané problémy měl zaměřit a odstranit činnosti, které jsou v nynějším zákoně postradatelné.

Abstract:

The Master´s thesis is devoted to the permitting process for the construction of accommodation facility and apartment building, and explains the functioning of the permitting process in the Czech Republic. The aim is to identify differences in the permitting process from the point of view of the building law when assessing two types of structures – accommodation facility and apartment building. The thesis is divided into three main parts: theoretical, analytical and proposal parts. The parts are further divided into chapters and sub-chapters. The theoretical part is devoted to the basic definition of the hotel and construction industry. The analytical part explains in more detail the permitting process for the accommodation facility and apartment building. It points to the legal requirements of these types of structures and the overall development of the construction industry. The proposal part describes the major deficiencies in the permitting process system, and recommendations for their elimination. Theses also mentions the new building law, which should focus on the issues and eliminate activities that are expendable in the current law.
