Tolerable risk in criminal law

Abstract:

Tato diplomová práce je věnována problematice přípustného rizika jako okolnosti vylučující protiprávnost. Vzhledem k nově začleněné zákonné úpravě tohoto institutu do nového trestního zákoníku č. 40/2009Sb. je práce namířena hlavně na osvětlení tohoto institutu, jeho historický vývoj a obecné vymezení jeho jednotlivých podmínek. Dále je zde rozpracována problematika rizika ve sportu a při medicínském experimentu. Na počátku práce je uveden výčet okolností vylučující protiprávnost činu a jejich obecné vymezení, což je nutné pro správné pochopení přípustného rizika jako nové okolnosti vylučující protiprávnost.

Abstract:

This dissertation is concerned with the issues of tolerable risk as a circumstance ruling out lawlessness. Considering the law alteration of this institute newly incorporated into the new criminal code no. 40/2009Sb., the dissertation is mostly focused on the explanation of this institute, its historical development, and a general definition of its particular conditions. The issues of risk while doing sport or during a medical experiment are also elaborated. At the beginning of the dissertation, there is a listing of circumstances (and their general definition) ruling out lawlessness included necessary to properly understand the issue of tolerable risk as a new circumstance ruling out lawlessness.
