EU counter-terrorism and its Czech criminal-law reflections

Abstract:

Soudobý terorismus je fenoménem, který překračuje hranice států, děsí společnost a upoutává pozornost politiků, bezpečnostních expertů i právnické veřejnosti. V první polovině této dekády dochází v prosperujících evropských zemích zdánlivě bez příčin ke strmému nárůstu závažných teroristických útoků, u nichž je deklarována islamistická motivace pachatelů, a spolu s tím i k nárůstu počtu usmrcených, zejména z řad nezúčastněných civilistů. Západní Evropa je konfrontována s poznáním, že součástí společnosti je komunita, která nerespektuje tradiční civilizační hodnoty, a která je ochotna vyjádřit svou nespokojenost a frustraci jakýmikoliv prostředky. Prvotní myšlenkou, která vedla k volbě tématu a ke zpracování této práce, bylo zjištění, že terorismus, jakkoli se jeho podstata zdá zřejmá, je ve své podstatě velmi nesnadno uchopitelný pojem. Jako nejasné se jevily také důvody, proč vlna smrtících útoků v posledních letech zasáhla tradiční tolerantní a liberální země, u nichž integrace přistěhovalců a koexistence kultur a vyznání nebyla pokládána za problematickou. Předkládaný text přibližuje, s jakým jevem má Evropa co do činění z hlediska kriminologie a jaké kroky jsou na společné (komunitární) úrovni podnikány, aby nebezpečné a nepředvídatelné útoky páchané ve jménu pomýlených náboženských idejí ustaly. Záměrem autora je dále podrobně ozřejmit, jaké nástroje a proč přinesla komunitární protiteroristická iniciativa do českého trestního práva, tuto úpravu zhodnotit a doplnit o příklady z rozhodovací praxe. V neposlední řadě má být práce příspěvkem do diskuse, zda lze uvažovat i o jiných opatřeních de lege ferenda, které by manévrovací prostor potenciálních pachatelů zúžily a učinily boj proti terorismu úspěšným.

Abstract:

Modern contemporary terorism is an international phenomenon that terrifies people and excites the interest of polititians, security experts and lawyers across borders. During the first half of this decade prospering Western-European countries became targets of alarming and unprecedented terrorist attacks characterized by the islamist motivation of offenders, seemingly without reason. At the same time there is a significant increase of casulties, innocent civilians. Western Europe discovers that there is a community of people who are not respecting the traditional European cultural values and who are able to express their dissatisfaction and frustration by all means. The first idea that came before writing this thesis was the fact that the term of terrorrism is a very complicated non-exact concept although it seemed that its substance and nature was clear to everyone. Also the reasons why the wave of fatal terrorist attacks hits the traditional, tolerant and liberal countries whose multiciltural society and religion-coexistence was considered as peaceable were unclear. Presented text describes what is Europe confronted with from the criminological point of view and what kind of measures have been taken at the tier of European Union to prevent dangerous and unpredictable terrorist attacks committed in the name of wrong religious belief. The intention of this thesis is also to clarify the regulation of Czech criminal law resulting from the European law, to describe this legal regulation and to add concrete judicial decisions. At the same time the thesis would like to liven up the discussion concerning the possible other political and legal measures de lege ferenda that could be potentially taken to make current counter-terrorism effective.
