Necessary defense and its limits

Abstract:

Rigorózní práce se zabývá institutem nutné obrany a zaměřuje se především na její meze. Autor si v úvodu práce stanovuje za cíl posoudit, zda jsou meze jednání v nutné obraně nastaveny v České republice tím způsobem, aby riziko případného trestního postihu neodradilo obránce od aktivní obrany svých zákonem chráněných zájmů. Pro důkladné posouzení přípustných mezí jednání v nutné obraně je potřeba mít dostatečný trestněprávní základ, a z toho důvodu se autor v prvních dvou kapitolách věnuje trestnému činu a jeho znakům, potažmo i institutu okolností vylučujících protiprávnost obecně. Na to autor navazuje stručným pojednáním o jednotlivých okolnostech vylučujících protiprávnost, neboť pro lepší uchopení institutu nutné obrany je vhodné, ji od ostatních okolností vylučujících protiprávnost odlišit a upozornit na její specifika. Následuje stěžejní kapitola věnována institutu nutné obrany, jejímu historickému vývoji až po současnou právní úpravu, přičemž největší pozornost je věnována právě mezím přípustného jednání v rámci nutné obrany. Pro lepší ilustraci autor vymezil několik zásadních otázek vycházejících z reálných případů, na kterých demonstruje soudní praxi v posuzování mezí přípustného jednání v nutné obraně. Celá práce je doplněna o komparaci institutu nutné obrany a mezí přípustného jednání v jejím rámci se zahraničím, a to konkrétně s úpravou tohoto institutu ve Spojených státech, v Norsku a na Slovensku. V poslední kapitole se autor pro komplexní uchopení mezí nutné obrany stručně věnuje mezím jednání v nutné obraně v jiných právních odvětvích, a to v právu správním a právu občanském, kde se rovněž institut nutné obrany aplikuje. V závěru se autor vrací ke svému cíli a vyjadřuje se k zakotvení institutu nutné obrany v České republice a navrhuje, jakým směrem by se zákonodárce mohl vydat v rámci dalšího legislativního vývoje tohoto institutu.

Abstract:

The thesis deals with the legal institute of necessary defense and focuses primarily on its limits. The author in the introduction sets out an aim to assess whether the limits of action in necessary defense in the Czech Republic are set in such a way that the risk of potentional criminal sanctions does not deter defenders from actively defending their legally protected interests. For a thorough assessment of the permissible limits of action in the necessary defense, it is necessary to have a sufficient criminal-law basis, therefore the author in the first two chapters deals with the crime and its features, and the institute of circumstances excluding unlawfulness in general. This is followed by a summary of other circumstances excluding unlawfulness because it is appropriate to distinguish necessary defense from other circumstances excluding unlawfulness and to point out to its specifics in order to better understanding of the institute of the necessary defense. Following is the main chapter of the thesis devoted to the institute of the necessary defense, its historical development to the current legislation, while the most attention is given to the limits of permissible acting in the necessary defense. For a better illustration, the author has defined several fundamental questions based on real cases, in which the author demonstrates judicial practice in assessing the limits of permissible acting in the necessary defense. The thesis is complemented by a comparison of the necessary defense and the limits of permissible acting in necessary defense with foreign countries, namely with the regulation of this institute in the United States, Norway and Slovakia. In the last chapter, the author deals with the legislation related to the necessary defense in other legal sectors, namely administrative law and civil law, where the institute of necessary defense is also applied. In conclusion, the author returns to his aim stated in the introduction and expresses his opinion on the establishment of the necessary defense institute in the Czech Republic and suggests what direction the legislator could take in the legislative process related to this institute.
