The pardon and amnesti from the president - a relic of feudalism of correction of justice

Abstract:

Tématem bakalářské práce je „milost a amnestie prezidenta republiky – feudální přežitek nebo korekce“. V této práci budu popisovat historii vyhlášených amnestií, milostí a rehabilitačních rozhodnutí. Důvod, proč má být tato práce napsána, je ten, že se vztahuje k hlavě státu a vůbec je to téma až zvláštní, protože najednou jeden člověk „prezident republiky“ se rozhodne, že vyhlásí rozhodnutí o udělení amnestie, milosti nebo rehabilitaci k určitému subjektu aniž by to musel obhajovat nebo zdůvodnit. V bakalářské práci se stručně popisují jednotlivé amnestie udělené prezidenty naší republiky od vzniku samostatného Československého státu a dále se hlouběji zabývám charakteristikou a popisem vyhlášených jednotlivých amnestií, milostí a rehabilitací, které kdy byli prezidentem republiky uděleny, až do současnosti. Dále v praktické části budu porovnávat milosti udělené bývalým prezidentem Václavem Havlem a současným prezidentem Václavem Klausem. Samozřejmě, že není možné, abych popsal všechny momenty, které vymezovaly nebo působily na proces kontroly politických procesů při vyhlášení amnestie, milosti nebo rehabilitace za celé období vzniku Československa až po současnost, ale přesto se v bakalářské práci nevzdám stanoveného cíle, který jsem si na začátku vymezil.

Abstract:

The theme of the Bachelor thesis is „Pardon and amnesty given by the President of the Czech Republic – fedual relic or correction“. I'll describe in this work the history of the proclaimed amnesties, pardons and rehabilition decisions. The reason why this is to by written, is that it applies to the head of state and it is very special theme, because suddenly one man „President of the Republic“, decides to dolare the decision to grant amnesty, grace or rehabilition to soubody without to defend or justify his decision. In the Bachelor's work I briefly describe each of the amnesty granted by the President of the Czech Republic since independence of our republic and further I explore deeper the charakteristic and description of each amnesty, pardon and rehabilition which were granted by the President of the Czech Republic from past until now. Furthermore, in the practical part I'll Compare the pardons granted by the former President Václav Havel and the current President Václav Klaus. Of course, that it is not possible to describle all the moments which defined or interacted on the process of control of political procesess by the announcement of the amnesty, grace or rehabilition for the whole period from the beginnig of Czech Republic to the present day, bud in the Bachelor's work I won't give up to the desired objektive, which I established at the beginnig.
