Protection of the Good-faith Acquirer's Rights in Opposition to the Protection of the Rights of the Original Owner

Abstract:

Diplomová práce se zabývá střetem práv původního vlastníka a nabyvatele v dobré víře ve sporu o vlastnické právo při nabytí od neoprávněného. Je porovnávána možnost nabytí vlastnického práva od neoprávněného v souvislosti se změnami, které přinesl nový občanský zákoník a se zaměřením na nemovitosti. V poslední části práce je věnován prostor analýze judikatury Nejvyššího soudu a Ústavního soudu, jelikož mají tyto soudy k možnosti nabytí vlastnického práva k nemovitosti od neoprávněného před nabytím účinnosti nového občanského zákoníku zcela odlišný postoj.

Abstract:

The thesis is focused on the conflict between the rights of the original owner and good-faith acquirer in a dispute over property right caused by acquisition from an unauthorised person. The possibility of acquisition of property right from unauthorised is compared in the context of adopting a new Civil Code and is focused on immovable things. The last part of the thesis contains analysis of the Supreme Court´s and the Constitutional Court´s case law due to the fact that the Courts have a completely different opinion about the possibility of acquisition of property right to an immovable thing from an unauthorised person before the new Civil Code became effective.
