The Status and Function of a Notary in a Probate Process

Abstract:

Tato diplomová práce si klade za hlavní cíl především zabývat se postavením notáře v řízení o dědictví. Na začátku práce je věnován prostor nastínění historického vývoje notářství v období od konce 19. století až po současnost. Další část práce uvádí základní informace nejen o notářství samotném, o jeho významu a základních zásadách, ale i o jeho současné právní úpravě a především také o jednotlivých oblastech notářské činnosti. Samotné jádro práce tvoří část věnovaná právě postavení notáře v řízení o dědictví. Zde se práce zabývá úlohou a funkcí notáře postupně v rámci průběhu celého tohoto řízení a nově i jeho povinnostmi po skončení řízení o dědictví. Práce se stručně zabývá i postavením notáře v řízení o dědictví podle zahraniční právní úpravy. Zvolena byla právní úprava rakouská. V samotném závěru jsem se zabývala zkoumanou problematikou z pohledu praxe a nastínila, jaká pozitiva, otázky či dokonce komplikace přinesla nová právní úprava postavení notáře v řízení o dědictví.

Abstract:

The goal of the present diploma thesis is to analyze the status of the notary in a probate process. The thesis opens with an overview of the historical development of the notary practice in the period from the end of the nineteenth century until present. The next section presents basic information not only about the notary practice as such, its significance and core principles, but also about its current legal regulation and above all, about the various areas of the notary activities. The core of the thesis focuses on the status of the notary in a probate process. Here the role and function of the notary throughout the whole process is analysed as well as their obligations once the probate process has been concluded. The thesis briefly touched upon the status of a notary in the probate period as stipulated by a foreign legal regulation. It was selected the Austrian legal regulation. The concluding section focuses on the subject matter from the point of view of practice and discusses positive and negative points of as well as obstacles caused by the new legal regulation of the notary’s status in a probate process.
