Authorities Protecting Public Interest (Supreme Audit Office and Office of the Government Representation in Property Affairs)

Abstract:

The subject was intended on two authorities - Supreme Audit Office and Office of the Government Representation in Property Affairs. The existence of an independent audit system is a one of the indispensable prerequisites for good functioning of a modern democratic state. In the Czech Republic this function is performed by the Supreme Audit Office (SAO), which has been enshrined in the Constitution of the Czech Republic. The Constitution, besides legislative, executive and judicial power and other constitutional elements, defines the status of the SAO as an independent body in a separate charter. The SAO performs its functions independently, being dependent neither on the legislative power (parliament) nor on the executive power (government) and represents one of the specific elements of parliamentary democracy. Organizational bodies of the SAO are: president of SAO, vice-president of SAO, Board of SAO, Senates of SAO, and Reproach Chamber of SAO. The Board consists of the President, the Vice President and 15 members of the Office. The members of the Office are elected by the Chamber of Deputies of the Parliament of the Czech Republic; their term of office lasts continuously until they attain the age of 65 years, and their status is comparable to the status of the members of parliament. The Office of Government Representation in property affairs (Office) was established on 1st of July 2002 by the decision of the Parliament based on the Government proposal, on the basis of the Act No. 201/2002 Coll., Act on the Office of the Government Representation in Property Affairs. It is an organizational constituent of the State - an independent accounting unit - falling under the Ministry of Finance of the Czech Republic Main task of the office is to represent the State and municipalities at court hearings, arbitration committees, administration authorities and others, and to manage the state property and protect it. This happens on the basis of skilled and professional activities of employees of the Office working throughout the whole territory of the Czech Republic. After the experience of the past period, we could say that a large part of the community in the Czech Republic were acquainted with the activities which the Office provides. In many European union countries and also troughout the world offices exist with very similar function to the Office of the Government Representation in Property Affairs in Czech Republic.

Abstract:

Predmetom tejto diplomovej práce je pojednávanie na téma ochrany verejného záujmu, ktorú vykonáva Najvyšší kontrolný úrad a Úrad pre zastupovanie štátu vo veciach majetkových a následné priblíženie funkcií a činností samotných úradov. Potrebnosť a dôležitosť tejto témy si v prvom rade treba uvedomiť na úrovni verejnej správy, ktorá rozhoduje na základe zákona a pochopiteľne v jeho medziach o právach a povinnostiach právnických a fyzických osôb. Verejná správa je v modernom štáte chápaná v zmysle výkonnej činnosti štátu ako základného verejnoprávneho subjektu, ktorá je uskutočňovaná prostredníctvom jeho orgánov spočívajúcich v správe verejných záležitostí a je realizovaná ako prejav výkonnej moci v štáte.
