Abstract:

Diplomová práce se zabývá českou právní úpravou honebních společenstev a mysliveckých spolků. Práce je mimo úvodu a závěru rozdělena do devíti logicky po sobě jdoucích částí, které se dělí na další kapitoly a podkapitoly. V první části jsou vymezeny použité pojmy, jakými jsou zejména honební společenstvo a myslivecký spolek. Ve druhé části je uveden historický vývoj právní úpravy spolků a spolkové myslivosti na území českých zemí. Na základě popsaného historického vývoje je vyzdvižena nezbytnost existence honebního společenstva pro umožnění výkonu práva myslivosti. Ve třetí a čtvrté části, které jsou výchozí pro další části a některé závěry, je uvedena současná právní úprava spolků, mysliveckých spolků a honebních společenstev. V dalších částech je pojednáno o vztazích mezi těmito korporacemi, o stanovách obou korporací a jejich náležitostech a o právním jednání těchto korporací. V posledních dvou částech práce je vypracována analýza aktuálních stanov existujících mysliveckých spolků a je provedeno srovnání české právní úpravy honebních společenstev a mysliveckých spolků s německou, resp. bavorskou právní úpravou obdobných korporací. Hlavním cílem práce je na jednom místě obsáhnout a analyzovat pravidla, která tvoří základní právní rámec honebních společenstev a mysliveckých spolků a se zaměřením na právní jednání popsat vztah, do kterého tyto korporace mezi sebou vstupují.

Abstract:

The thesis contains the Czech legal regulation of hunting societies and gamekeepers associations. Apart from the introduction and conclusion, the work is divided into nine logically consecutive parts, which are divided into further chapters and subchapters. The first part defines the terms used, especially hunting society and gamekeepers association. The second part contains the historical development of the legal regulations of associations and hunting societies in the Czech lands. Based on the described historical development, the necessity of the existence of hunting societies is emphasized to enable the exercise of hunting rights. The third and fourth parts present the current legislation of associations, gamekeepers associations, and hunting societies. These sections are the starting points for other parts of the thesis and some conclusions. The following sections deal with the relations between these corporations, the statutes of both corporations and their content requirement and the legal behavior of these corporations. The last two parts contain an analysis of the current statutes of existing gamekeepers associations and a comparison of the Czech legislation of hunting societies and gamekeepers associations with the German, respectively. Bavarian legislation of similar corporations. The main aim of the thesis is to cover and analyze in one place the rules that form the basic legal framework of hunting societies and gamekeepers associations. Furthermore, focusing on legal action to describe the relationship in which these corporations enter into each other.
