Strengths and Weaknesses in Modification of Proceedings in the Construction Act Mode (in the Building Act Scheme)

Abstract:

Diplomová práce se věnuje úpravě řízení v oblasti stavebního práva. Hlavním cílem je praktický pohled na problematiku řízení směřujících k povolení konkrétních stavebních záměrů. První část práce je koncipována jako srovnání jednotlivých povolovacích procesů po stránce věcné a jejich hodnocení zejména z pohledu žadatele. Následující část je věnována pohledu na samotný proces s ohledem na běh času a jeho porovnání s právem na spravedlivý proces. Práce se věnuje aktuálnímu stavu stavebního práva po velké novele účinné od 1. 1. 2013, poukazuje na některé nelogičnosti a nekoncepčnosti právní úpravy jako celku a navrhuje jejich možné úpravy de lege ferenda.

Abstract:

This thesis is concerned with the legislation of proceedings in the field of constructive law. The main aim is to show a practical view of problems regarding building permits' procedure. The first part is supposed to be a comparison of particular permitting processes and an evaluation of these processes, mainly from applicant's point of view. The following part deals with the proceeding itself considering the passage of time and the right to fair trial. This thesis discusses current situation of construction law after the change of the legal regulation of this field which came into effect on 1st January 2013 and indicates some illogical and unsystematic parts of new legislation and proposes possible changes “ de lege ferenda”.
