Legal Aspects of the Search in the File in the Administrative Proceedings
Abstract:
Práce pojednává o problematice nahlížení do spisu ve správním řízení. Zabývá se analýzou jednotlivých institutů zakotvených v právních předpisech správního práva a rozborem související judikatury. Poukazuje na problémy konkurence správního řádu a zákona o svobodném přístupu k informacím a na úskalí týkající se omezení práva do spisu nahlédnout.
Abstract:
The thesis deals with the questions of the search in the file in the administrative proceedings. It is considered with an analysis of particular institutes embedded in legal enactments of the administrative law and with an analysis of judicature.
