Interpretation of Vague Concepts in Administrative Law

Abstract:

Diplomová práce pojednává o neurčitých pojmech ve správním právu. Teoretická část se věnuje právu, jeho tvorbě, právnímu jazyku a neurčitosti práva, rovněž tak aplikaci a interpretaci práva. Následující část se zabývá neurčitými pojmy, včetně generálních klauzulí, charakteristikou neurčitých pojmů a jejich postavením v právním řádu. Práce se dále zaměří na interpretaci neurčitých pojmů správními orgány a možností jejich soudního přezkumu. Praktická část práce je věnována analýze vybraných neurčitých pojmů, při níž bude využita judikatura správních soudů, Nejvyššího správního soudu a Ústavního soudu.

Abstract:

The diploma thesis deals with vague concepts in administrative law. The theoreti-cal part is devoted to the law, its creation, the legal language and the uncertainty of law as well as the application and interpretation of law. The following part deals with vague terms, including general clauses, the characteristics of vague terms and their status in the legal order. The work will also focus on the interpre-tation of vague terms by the administrative authorities and the possibilities of their judicial review. The practical part is devoted to the analysis of selected vague terms, which will use the case law of administrative courts, the Supreme Administrative Court and the Constitutional Court.
