The risks and consequences of the incorrect decisions of authorities with the impact to privacy and immovable assets

Abstract:

Tato práce se zabývá vyhodnocením otázky rizik, příčin a následků chybných rozhodnutí úřadů s dopadem do soukromí a ceny nemovitého majetku. Práce analyzuje negativní dopady úředních rozhodnutí do soukromého života obyvatel nemovitého majetku rodinného domu a zahrady, který před zásahem úředního rozhodnutí poskytoval rodině prostor k relaxaci. Formou případové studie je prozkoumán konkrétní případ ve sledované lokalitě a jsou popsány postupy úřadů s vyčíslením majetkové újmy. Práce zkoumá, jaké podklady a postupy úřady využily pro opakované nařízení uřezání a devastace okrasných stromů na pozemku okrasné zahrady, která dříve plnila rekreační a relaxační funkčnost pro pohodu bydlení u rodinného řadového domu. Práce dále zjišťuje a identifikuje příčiny problémů, analyzuje rizika majetkové a nemajetkové újmy. Práce zkoumá vyhodnocení výsledků znaleckých posudků, postup úřadů při terénních prohlídkách a jejich následnou aplikaci do rozhodnutí. K šetření byly využity metody polostrukturovaného rozhovoru s několika advokáty a soudními znalci. V závěru práce je zpracováno doporučení návrhu na zlepšení způsobu vyhodnocení odborných materiálů a znaleckých posudků a postupu místních šetření v podobných případech.

Abstract:

This thesis is focused on the evaluation of the matter of risks, reasons and consequences of the fault decisions of authorities with an effect to privacy and the price of immovable assets. The thesis analyses the negative impacts of administrative decisions to the private life of the inhabitants of a family house with a garden, which were utilised by the family for relaxation before the intervention of the administrative decision. This thesis is focused on one particular case in a monitored locality by the form of a case study and describes the procedures of authorities with the calculation of property detriment. The thesis inspects, which sources and procedures were used by authorities for the order of the repeated cutting and devastation of decorative trees on the land of the decorative garden, which was utilised for recreational and relaxing functionality for the peace of housing in the family row house. Besides, the thesis finds out the identification of the reasons of these problems and analyses the risks of property and non-property detriment. This thesis studies the evaluation of the results of expert opinions, the procedure of authorities at terrain inspections and their consequent application to the decision. The methods of semi-structured conversation with several lawyers and court experts were used for the survey. The end of the thesis concerns the recommendation of a proposal how to improve the way of the evaluation of expert materials and expert opinions and the procedure of local investigations in similar cases.
