Personal injury claims for damages caused by medical malpractice

Abstract:

Rigorózní práce se zabývá nárokem pacienta na náhradu nemajetkové újmy způsobené mu při poskytování zdravotní péče. Mapuje právní úpravu odpovědnosti poskytovatele zdravotních služeb, definici pojmu lege artis/non lege artis a zaměřuje se na procesní aspekty uplatňování uvedeného nároku v rámci medicínských sporů, zejména problematiku přesunu důkazního břemene a další procesní otázky. Prostor věnuje zejména východiskům pro stanovování výše zadostiučinění přiznávaného za újmu na zdraví. Podrobně se zabývá systematikou Mezinárodní klasifikace funkční schopnosti, disability a zdraví, stejně tak jako analýzou Metodiky k náhradě nemajetkové újmy na zdraví.

Abstract:

This thesis deals with patient’s claim for compensation for non-pecuniary damages caused to him by the health care provided. It covers the statutory provisions for the liability of the provider of health services, defines the terms lege artis and non lege artis, and deals with the procedural aspects of applying such a claim in medical disputes, particularly the issue of the burden of proof in medical malpractice cases and other procedural issues. The thesis gives attention to the basis for determining the amount of satisfaction awarded for personal injury. It deals in detail with the system of the International Classification of Functioning, Disability and Health as well as with the analysis of the Methodology for the compensation of non-pecuniary damage to health.
