Abstract:

ABSTRAKT Slavné dílo George Orwella, antiutopický román „1984“, předpověděl neustálé hromadné sledování občanů ze strany vlády autoritativních režimů. To co bylo původně myšleno jako imaginace, se stalo skutečností. Technologický pokrok posunul způsoby kriminality a zároveň boj proti kriminalitě z tradičních způsobů na digitální. Tyhle zločiny narušující bezpečnost státu vyžadují prioritní omezení. Soukromí jednotlivce, které se snaží na jedné straně stát ochránit následně porušuje neustálým dohledem. Cílem práce je zodpovědět otázku jestli je sledování pomocí elektronických masmedií v souladu s právem občana a jestli jsou tyhle informace pečlivě sesbírané zachovávané a jak je s nimi naloženo. Ze všech afrických zemích Etiopie a Egypt jsou ty, ve kterých bylo dokázáno porušování lidských práv prostřednictvím elektronických masmedií a jejich využíváním k zastrašování a vyhrožování opozičním stranám. Při psaní této práce byla využita metoda kvalitativní analýzy, pomocí které se autor snaží vyhodnotit rizika spojená s kyberkriminalitou a její reálný vliv na občany. Celá analýza je založená na zkoumání využití masmedií za účelem sledování obyvatelstva, přičemž jsou porovnávány autoritativní vlády (Etiopie, Egypt) se západní demokracií. Zkoumáním bylo zjištěno, že vlády jednotlivých států potřebují masmédia k zabezpečení národní bezpečnosti např. k zabránění teroristických hrozeb. Avšak využití těchto masmedií by mělo být prováděno podle určitých zásad a v souladu s právem občanům. V závěru autor dospěl k názoru, že využívání masmedií k sledování občanů a k dohledávání osobních údajů je nevyhnutelné, ale je zde důležité najít určitou rovnováhu, aby celá tato činnost byla legální a nepoškozovala práva občanů.

Abstract:

George Orwell’s famous publication “1984”prophetically predicted a dystopian state of constant mass surveillance on citizens by governments in an authoritarian fashion, feigned in the mind as phantasm it eventually descended from the realm of imagination to reality. Modern technological advancement shifted the methods of crime and crime combat from conventional means to digital. These crimes that undermine the security of the state require states to take up a leading role in curbing. The general problem of the deployment of mass surveillance tools by government to check the incessancy of digitally facilitated crime is the tendency to flagrantly intrude into the privacy of the individual whose interest the state seeks to protect.The quizzical posture of the thesis was not to broadside governments’ surveillance policies once carried out in good faith with respect of the laws whiles they do that with herculean endurance in safeguarding nationals against real or perceived threats: planned, facilitated and channelled through electronic media.Ethiopia and Egypt were cited for deploying surveillance tools for purposes divergent from seeking national security to seeking government’s security such as ensuring political and social control. A critical qualitative analysis and assessment of the threat of crime occurring in the cyberspace with its effect in the physical by comparing democracies and authoritarian governments with Egypt and Ethiopia on one hand and western democracies on the other hand revealed the need for states to enhance the security of their countries in a world punctuated by crimes. Satisfied with the inevitability of the role of the state to ensure national security through mass surveillance, I made informed recommendations for policies makers regarding how to maintain a balance between security needs and individuals’ rights in a world vulnerable to organized crime.
