Business name and its legal protection

Abstract:

The thesis is dealing with an overview on the protection of a trading name. We have chosen for such a classification of findings, which simplify the understanding of the given theme. The first chapter „Trading Name“ we have dedicated to the mapping of the history of the establishment of a trading name. This part of the analysis is of significance from the development’s point of view, which was passed unto our legislation from the Austro-Hungarian Monarchy up to our present times. The term of a trading name, which is described in the following subchapter, is foremost defined in the commercial code and the civil code laws. Since it has been our attempt to approach not only to all possibilities of the trade name protection in the Slovak Republic as well as within international law, in particular within the European Union, the following chapters are divided as such. Within the frame of the legislation of the Slovak Republic, we will deal with the legal position of owners of a trade name that is the legal protection of trade names as stipulated in the commercial and the civic code laws. It is addressing the possibilities of deceptive competition, and the protection of intellectual property. In the conclusion of the said chapter will discuss the aspects of the legal protection of trademarks. As the protection of a trade name is likewise possible from the penal code, we also highlight these possibilities of legal protection. In the subsequent chapter, which is dedicated to international law, we focus the European Union legislation, which responds to issues arising from the protection in an international context. The last chapter analyses the possibilities of enforcing current legislation even on the protection of names and domains. It deals with the virtual world of internet, which, as a revolutionary technology, has not only brought with it positive, but also negative aspects.

Abstract:

Práca sa zaoberá prierezom témy ochrany obchodného mena. Zvolili sme takú systematiku poznatkov, ktoré zjednodušujú pochopenie danej témy. V prvej kapitole „Obchodné meno“ sme sa zamerali na zmapovanie histórie vzniku pojmu obchodného mena. Táto časť práce je dôležitá z pohľadu vývoja, ktorým prešla naša legislatíva od Rakúsko-Uhorskej monarchie až do dnešných čias. Pojem obchodné meno, ktoré sme popísali v ďalšej podkapitole je definované predovšetkým v Obchodnom a Občianskom zákonníku. Keďže našou snahou bolo priblížiť nielen možnosti právnej ochrany obchodného mena v Slovenskej republike ale aj v medzinárodnom práve, predovšetkým v Európskej únii, ďalšie kapitoly sú delené v tomto zmysle. V rámci legislatívy Slovenskej republiky sa zaoberáme právnym postavením majiteľov obchodných mien, právnou ochranou obchodných mien v zmysle Obchodného a Občianskeho zákonníka. Venujeme sa aj možnostiam ochrany proti nekalej súťaži, ochrany v zmysle duševného vlastníctva. V závere kapitoly pojednávame o problematike práv ochranných známok. Keďže ochrana obchodného mena je možná dokonca aj v zmysle Trestného zákona, uvádzame aj tieto možnosti legislatívnej ochrany. V ďalšej kapitole, ktorá je venovaná medzinárodnému právu popisujeme legislatívu Európskej únie, ktorá reaguje na problémy vznikajúce s ochranou v medzinárodnom kontexte. Posledná kapitola práce pojednáva o možnostiach uplatňovania súčasnej legislatívy aj na ochranu mena domény. Jedná sa virtuálny svet internetu, ktorý ako revolučná technológia priniesla so sebou nielen pozitíva, ale aj negatíva.
