Volný pohyb pracovníků patří mezi základní svobody Evropské unie, které přispívají k fungování vnitřního trhu. Pojem pracovník je unijním pojmem, který nelze vykládat podle vnitrostátních právních řádů. Nikdy nebyl právně zakotven, a proto v jeho výkladu hraje klíčovou roli ESD. Free movement of workers is one of the fundamental freedoms of the European Union, which are contribute on the functioning of the internal market. The meaning of „worker“ is a matter of European Union law, which cannot be interpreted according to the national systems of the law.
